hi! i am about to put some links to where my mixes can be downloaded. my mixes are 80 minute long mp3 files with 40 tracks of various dance and trance artists. i am wondering if it is cool to provide lets say an edonkey link to such mp3 file on your website. i don't want no trouble, u know.
could u give me some links probably to related legal documents, please, if u know any on the net. |

Nou is spot on there, you can put links to your mixes in the dj forum as long as you legally own the tracks in your mixes.

| And how does an objective viewer determine if someone actually owns these tracks or not? |

| When you say legally own the tracks, i think you better point out if you Legally own the rights to the track, or own the track on vinyl or something |

They can't...
right???? :S... :s

and most importantly, nor can someone who represents the maker of the tracks legally... right?
and if they e-mail u asking the question,
u don't have to reply, right? |

| no, it is not legal, whether or not you own the track (on vinyl, mp3, cd, or whatever) or not. here is the reason. on every recording that you purchase, there is a copyright that says, "Unauthorized copying, hiring, renting, public performace and broadcasting of this record is prohibited." (read all the little fine print.) i would say that mixing a set, and distributing it on the internet constitutes "public performance and broadcasting." now, whether or not you are actually going to be prosecuted for this is another matter. i think that it is safe to say that you won't be, but it is still illegal (just like littering, which is illegal, but nobody gets caught). |

| That whole fine print part of your argument only really comes into play if you are looking for payment for the mix being downloaded. |

Of if you play illegal stuff in a club, or on radio, or on a mix...
play some unreleased stuff and you could be done... |

As long as you are not charging for the sets you should be ok as they are promotional and you are promoting the tracks that the artists have produced.
This is how it works for vinyl I'm pretty sure. What would be the point of paying £8 for a record that you can only use in your bedroom and that only you can listen to?
Some hosts do not allow mp3 filenames to be uploaded due to these issues (is it legal is it not) just to keep themselves out of trouble so be aware of such hosts when picking one. |
