I think they are all for uploading, or 'sharing', or 'distributing'. I haven't read any cases or reports about filesharers recently but I'd imagine somewhere in the report or case would be indication that the offender was caught for uploading, not downloading. But if you can lead me to evidence of anyone being found guilty of downloading music then I will gladly stand corrected.

That said, I don't wish to encourage the downloading of Dance music because the industy simply can't afford it.

no your missing the point. you cant drag your hifi /dj equip. out into the road and start playing music to groups of people becasue you dont have a license to do so.

pubs, bars, clubs do have a licence so DJing at them isnt illeagal! :)

So when I'm having a party at home I can't play any music? :conf:

No sorry...

Any samples you use will be illegal, unless they are paid for and purchased.

You also will have to pay money to the company who's CDRs you used, because they helped you make a copy of the music, some royalties will go to the computer company who's computer you used to make the music.

The only thing you can do, is to use kitchen untensils: wooden spoon, and hit them against untensils. But then the cookware companies will sue...

So, you can only clap your hands, and use your voice...

sorry.....

:tongue3

What you do in your home is your business, so long as you don't breach the peace. The point Nell was making (I think) was that the street is a public place so technically you will be playing to the public. Your home is your home, not a public place. Unless it has a public footpath through it.

Um, see if this helps...

When in your own home you can flash yourself to someone passing in the street - they are looking into your home and so can do nothing about it. But if you were in the street an you flashed to someone in their home, they can complain about you. Similarly, if you flashed to someone who was in their home, while you were in your home they can also complain about you. That's what it's basically like in the UK anyway. In America it would probably be - You can't flash at a giraffe while it's urinating on a cactus, or something.

relax, playing a cd at home, or in your car on the street, or in a boombox over your shoulder, is not the same as playing in public venue like a club or bar.;)

I might be completely wrong here and this is just a memory from the back of my head (and it might differ stateside)

but i thought broadcasting or public performance is when you play to 7 people or more? regardless of venue

its going to vary by jurisidiction, country, province, state, city. . . it may be defined that way in some place, but i highly doubt it.

even if it was, i'm sure there would be an exception if you knew the people, or they were unknown to you. other factors might include whether it was for profit, whether anyone could enter (a public place) or whether it was a member's only facility (a nonpublic place), and so forth. its goingt to depend on the place and the specific facts.

there is no one rule that is applicable everywhere, as far as i know. i'd be suspicious of anyone that claims so.

I probably shouldn't have used 'flash' in my example. Realised later yesterday but couldn't come back to edit. I didn't mean purposely flash someone, as in a 'flasher' but accidental flashing.
But I'm doubting now that that would make any difference, because I can't find anything to back up my previous post, though the reason I did think that in the first place was due to a program about 'Recommendation 54'.
