seem like a lot of cops on your side of the water like to show how powerful they are for any reason they feel like.

sad, very sad.

well you guys only hear the bad and wrost stories. there are a lotta good cops out there, its just no fun to tell stories about good cops, cause usually its a story where you ed up.

as for this story, you better have a recipe. that would show you weren'tloitering, since the cops were unaware of your bagel purchase. that shoudl resolve everything, so no need to get panties in bunches.

This happened to me today. Me and my friend get a $50 ticket for loitering. Un-ing-believable.

Story: It may seem long, but please read it :) And give some feedback.

Discuss.

that's messed up dude. to be devil's advocate, cops have to deal with a fcuk load of little twats who think they're the and give nothing but attitude.

but in this case, the cops are being serious wankers. take it to court. i'd bet money they won't even waste the time to show up cause they know there's a good chance it won't be worth their while. they just want to make your life miserable.

lemme guess... North York?

We went back to Tim Hortons and got a letter from them saying we purchaced 2 bagels. I also looked on the Canadian Gov. Website and found this:
quote:

Causing disturbance, indecent exhibition, loitering, etc.
175. (1) Every one who

(a) not being in a dwelling-house, causes a disturbance in or near a public place,

(i) by fighting, screaming, shouting, swearing, singing or using insulting or obscene language,

(ii) by being drunk, or

(iii) by impeding or molesting other persons,

(b) openly exposes or exhibits an indecent exhibition in a public place,

(c) loiters in a public place and in any way obstructs persons who are in that place, or

(d) disturbs the peace and quiet of the occupants of a dwelling-house by discharging firearms or by other disorderly conduct in a public place or who, not being an occupant of a dwelling-house comprised in a particular building or structure, disturbs the peace and quiet of the occupants of a dwelling-house comprised in the building or structure by discharging firearms or by other disorderly conduct in any part of a building or structure to which, at the time of such conduct, the occupants of two or more dwelling-houses comprised in the building or structure have access as of right or by invitation, express or implied,

is guilty of an offence punishable on summary conviction.

As far as I'm concerned, we were not doing anything listed above.

As well as this:
quote:

Legal rights
The Charter also protects the individual and ensures fairness during legal proceedings, particularly in criminal cases. The rights to habeas corpus, or the right to challenge being detained or held, and to be presumed innocent until proven guilty – always recognized as part of our law – are now guaranteed in our constitution.

No one can be deprived of the right to liberty and security of his or her person except through proper legal procedures. Canadians are protected against unreasonable searches and seizures, and against police using excessive force, even when a search or seizure is authorized by law. We are also protected against being detained or arrested arbitrarily. In other words, a police officer must have a reasonable suspicion that we have committed a crime before holding us in custody.

The Charter also protects us against arbitrary actions by law enforcement agencies. It guarantees our rights to be told why we are being arrested or detained, to consult a lawyer without delay, to be informed of this right, and to have a court determine quickly whether the detention is lawful.

And this was in Mississauga, ON

well, yeah, in this case, wouldn't they need a warrant, since giving a guy a cigarette doesn't exactly seem to qualify as probably cause, imo.

They couldn't tell that it was a cigarette, though.

yeah heres the basic points:

Loitering falls under a "broken windows" policy of reducing little crimes to get rid of a general sense of criminal behavior. Increases in neighborhood local policing to reduce the rate of serious crime. Doesnt work but people actually like it better and it DOES reduce minor crime. Loitering is a crime because it is under a profile of actions that drug dealing falls under. Plus tends to lower business. Its just not a thing to do, especially on privately owned property which chains are.

Now, they were in a place legally seeing what they were seeing, which looked like a drug pass. Upon inspection, however, they were able to see and smell ciggie instead of weed. The removal of pockets wasnt really justified. Terry stops/pats are for officer protection and are not called for on social contacts, which that was. If you HAD weed, it would have been 100% justified, but them having a suspicion found to be false means that they had no reason to ask you to empty pockets. You had the right to refuse at that point.

The purchase of items from the store and the subsequent ticketing for loitering was also unjustified. There was no reason to do that, and the letter of the law is more to stop people with no where to go hanging out than honest citizens waiting for a friend. With no information to the contrary and according to your profile they should not have written a ticket for that.

Just say "it offended my sense of liberty and ordered justice and I feel like I cant smoke a cig and hang out with my friends any more"

it rings of a certain supreme court case :D

What the hell is "loitering"? Standing still in a public place? I don't get it. :conf:

Anyway, kill the cops through bombs in their cars so they can't get to court. :wtf:
