Paris — France has updated a two-century-old law to remove a distinction in the legal status of children born out of wedlock and those born to married couples.

The change approved by the cabinet on Monday removes the distinction between a “legitimate” child and a “natural” child born to unmarried parents, which first appeared in the 1804 Napoleonic code.

The revision means that the relationship of an unmarried mother to her child will automatically be recognized. Until now, unmarried mothers had to go to city hall to register themselves as new parents. Unmarried fathers will still need to declare themselves officially to authorities.

Almost half of all births in France in 2004 were to unmarried couples, compared with only 11.4 per cent in 1980.

The new measure was passed by the cabinet, a rarely used tactic that moves quickly and bypasses parliament.

I'm surprised. Almost half? I wonder how many babies are born to common law couples, and how many to single moms. Single parenting sucks, esp. if the parent has to work and not be able to properly give the attention to the kid as needed.

This is quite sexist. Why cant fathers be extended the same rights? Oh i forgot, their only role is to be a 24 hour ATM.

If the relationship of the mother to the child is automatically recognized - does this not also mean that the financial responsibility is appropriated with that recognition? Therefore, by fathers still retaining the right to "declare" paternity they uphold the more favourable position with respect to potential financial obligation.

Until the courts come after him....

But you make a good point. There is actually a movement afoot to afford the same reproductive rights to men as women have. Men should also have the right to decide whether or not they wish to become parents. Not that forced abortion is being advocated, but men should have the right to decide whether they wish to be a father both financially and physically just as a woman has a right to this decision through abortion or adoption.

Yup... i think fathers are starting to realize how the law is biased and sexist. Look at that poor kid who got murdered on the weekend. The father wasnt allowed to see the kid but had to pay. Meanwhile the kid allowed to go off with a murderer that barely knew the child. How is that? If the father had more say in the child's life perhaps he'd still be here today? Very sad.

In Ontario, one only needs to be accused by the mother of abuse for the father to be stripped of all rights including custody and property rights regardless of any physical proof or eyewitness. In any other facet of law this would be completely illegal.

I have seen first hand how the current laws screw men over. My own cousin being one of them.

Could it be that in a wedlock situation, it may not be certain who the father really is? That's why it's not automatic? (Obviously this is not always the case, but maybe there's a high percentage of this in France which is one of the reasons for the rule...)
