Under section B you can receive 80% of your net income lost up to a maximum of $300/wk for time missed from work due to injuries. There is a one week deductible (you don't get anything for the first week missed). If 80% of your net income loss is over $300/wk you have a right of action against the at fault party for the rest.

With regard to a tort action.... if your injury is a Whiplash Associated Disorder the maximum you can receive from the other party by way of a tort action for Non-pecuniary damages (pain and suffering) is $4,000. If your injury is something more then whiplash PM me and I will run a quick quantum analysis to give you an idea of the damages you can claim.

In addition, by way of a tort action you can claim for a loss of housekeeping capacity both past and future if your injuries prevent you from doing tasks around the house.

BTW, you have two years from the date of the accident to make a suit for injuries or lost income from the other party. I would recommend, however, that you send a letter to them putting them on notice that you intend to commence a tort action against them. This will get the ball rolling on a claim that could get you a quick settlement rather then waiting for years.

Your ambulance bill is payable under the Section B benefits of the SPF (Standard Policy Form) 1..... the owner's policy in Alberta. All you should need to do is submit the invoice to your own insurer and they will reimburse you for it.

With regard to property damage Alberta works on a pure tort system. Given the details you have provided it is pretty clear the other party is at fault for the loss. Your insurance company will subrogate to their insurer to recover the damages they have paid as well as your deductible. You will get your $500 back once they have received payment from the other party's insurer.

Trust me my friend.... every insurance adjuster is just a little ed up in one way or another.... you have to be in order to do this kind of work.

My dad two days ago was at some trafficlights, before them is a blind corner, a car came flying around them lost controll and span it, into my dad, sent his car into a wall:whip:

He got wHiplash and we are waiting to see if the car is written off, hoping not as we will lose 2K.

About two weeks ago I was driving home from work on a four lane road. I was in the left lane, this woman in a Tahoe was ahead of me and in the right lane. At an intersection, she decides that it would be a great idea to make a last minute left turn... not from the left lane, not even from the left-hand turn lane where she should have made the turn, but from all the way over in the right lane. Directly in front of me.

*Smack*

Now, I was in an '05 Civic. I realized what she was doing and managed to react quick enough to cut a bit to the left, but I had no chance of avoiding her and hit her hard at an angle. Thankfully I didn't Tbone her straight on, as I would have had I not reacted. My car is pretty ed (current estimate is almost $6k and of course they might find more to do as time goes on). I'm probably going to sell the car and get insurance to reimburse me for the diminished value (full coverage rocks). Then I'll buy a new car.
