If it were me, I'd still cancel the charges. If he sends the real product, and you're feeling decent enough to give him the money at a later date, then do it. Otherwise, I wouldn't hold my breath waiting for this product to come.
I find it fishy that this guy can accept credit card payment, but needs extended time to send refunds. < SCAMMER. |

simple - call up your CC company, file a dispute and ask for refund on that charge (as stated above).
then rip him a nice hole through ebay feedback ;) |

i don't believe there is a time limit of the CC or it is much longer than eBay.
your first priority is to get your money back. forget the feedback stuff for now. |

So this whole mess has now come to a bloody end. I called my credit card company and alerted them to the unathorized purchase after I spoke with this joker on the phone and he told me he would send me a new one right now (he had been telling me this for the last 2 months) I told him all I wanted was a refund at this point since he even promised that to me 3 weeks ago.
Finally today was my last day available to leave feedback for him so I obviously left a negative since I had to threaten the bastard with legal action through various outlets (4 different authorites had letters drafted to them).
Now here is the fun part; within 45 seconds of me leaving negative feedback I get a reply back with negative feedback on my account. the best comment he could leave was "you can have 5$ off your next order" (yeah right I'll be using that!) obviously in retaliation back at me.
then 1 minute later I have a notice in my box that says he wishes to pursue a mutual negative feedback retraction. Even though it dropped my positive feedback 10 full percent from his one negative I've decided I'm keeping mine up and am not going to let him push around like this to keep his rating artifically high. (you can tell he has tried to do the same thing to every neg feedback he has recieved!)
I got my refund today less the cost of me having to return the first wrong product. So 89 days later, 7 bucks in shipping at my expense and hours trying to hold this guy accountable, one negative feedback and no product I originally paid for, I think I pretty much ended up on the loosing side of this stupid battle.

I've been thinking about actually emailing him saying now that I had his address I have no problems driving over to florida to kick his ass. He could expect me in the same time frame he ships faulty products... sometime between 2 to 89 days. ;)
I'd get satisfaction just outta making him sweat and watch his back for a three month time span, similar to the crap he put me through. :) |

yeah and I'll do it from a pay phone so he can't id it. :)
although I think my real voice can scare most people over the phone. I even get weirded out at how deep it sounds on voice mails sometimes! |

Order him some pizza from a local pizza shop who doesn't care about caller ID.
You have his full address and phone number!!!!!! Have fun with this!
