Legal Question

so my *ahem* friend is starting a podcast and posting it on his website and promoting it heavily coming soon...

does the "for promotional use only" thing for mix cds apply or since this is a "broadcast", over the internet, but still a broadcast in the sense, do you have to get some sort of legal disclaimer or properly sign the tracks from the labels?

I dunno if this applies in canada but in egypt i used to have a weekly broadcast on the radio and it had to have a special license and had to pay a fee everytime a certain song was played

Radio is different to net tho. I don't think you'd have too many issues, but not sure. i doubt anyone would chase you if your not selling the podcast... or rather your 'friend' isn't.

as far as Im aware legally that doesnt cover you, technically making mix cds is illegal. However, nobody cares unless you start making profit from it, and then you might hit trouble.

If you're really worried about it maybe you should contact some of the labels and/or artists on your mixes and ask what they think?

there is a new law in the senate in the us right now that there trying to get passed that would make it illegal to stream content. i would suggest contaction your senator about it.

but i live in canada, where i've smoked a bowl in front of my "governer" or priemier as they're called here

as far as i have understood, "for promotional use only" along with not profiting off that mix makes it semi-legal

at least to the point where no-one would even waste time persuing you

as for podcast, i assume that it could be considered a mix

i met an old lawyer friend from a couple years ago last night at a party, i'm supposed to email her today and she'll go talk to the copywright person in her firm

once i get some more info, i'll post it up
