So just because a solider did this, it means that Bush will get punished for it? Did Bush tell him to tourture the captured soldier?

given the extraordinary amount of effort the administration has gone into investigating the rules and who/how/why/if they apply, then id say the answer to that question is a resounding yes.

No, I do not think that is possible. That would go under an ex post facto law which is prohibited.

This is serious , and in all likelihood will get the ax by SCOTUS in the future. This part really is frightening:

Exactly how is that going to be defined?

By whatever the Bush says it is. Or perhaps more specifically, whatever Mike Addington and John Yoo defines it as, which they pretty much give all subjective and arbitrary definition to the discretion of the Executive.

And let's get something straight - there was no ing compromise by McCain and crew. McCain caved in huge as he saw the Conservative base he is attempting to court begin to get their panties in a bunch by his actions. Bush got pretty much exactly what he always wanted - Executive discretion to define laws enacted.

How exactly does that differentiate from what a King says and does really? I may be a little punchy with midterms right now, but last I checked even Congress cannot enact such Executive discretion to the point of where the Executive becomes the very definition of the Judiciary, can it? Isn't it the Judiciary that ultimately interprets such laws?

Jesus, I never thought I would have a ed up President given legal right to torture people and define who is a "terrorist". This is really a sad day for America.
