well, the link that celebstoner has in the article is the MySpace page of the alleged photographer here.

IMHO, forcing them to remove them, if it is illegal to do what they've done, is one thing...seeking to make "thousands" off of it is exactly what's wrong with society today.

what "loss" have you, as the photographer, suffered by them posting it? what contract did you have lined up with a buyer has been lost by them posting it?

If you did have options to make money from the pics, why would you post them on MySpace for anyone to d/l or "steal"? (I see they've been taken down, from a quick glance at your page, or aren't readily seen).

sorry, I just find this opportunistic lawsuit idea to be rather lame...it seems rather clear you had no intention of keeping the pics to yourself to sell to a mag or something if you posted them on MySpace.

now having said that...is it ok for this mag to use them without permission? no, of course not. I just wouldn't be crying foul and calling lawyers, seeking money. I'd seek to have the pics taken down...nothing more.

I dont want to sue anyone really. It was said in anger due to the fact that I did not ALLOW ANYONE to post any photos, anywhere. I had no intention of doing such, and in anger, was suggesting I had the RIGHT to sue.

Whether or not I pursue it-----more than likely not----but you'd be pissed too if somebody stole something from you.

^^^ actually, unless you were being sarcastic, you said that you've called a lawyer...that's a bit more than suggesting to us that you have the right to sue ;)

but I agree with you...and yes, I would be pissed if someone posted my pics without permission (although they did at least give you credit for them by linking your page).

if anything, you may get some more traffic on your MySpace...maybe you should thank them, not sue them, LOL.

in any case, sweet ing pics...those are gold ;)

dude! srsly! EARTH CALLING! you posted it on MySpace! it's a 100% public website, where can ppl can save any pics they want to, otherwise it would have that option disabled (right click, save as wouldn't work)

who stole what? you posted them for public viewing, with no copyright mark... if anything maybe they are not even ur pics

calling a lawyer to learn about what options i did have, is by no means starting the process of suing someone.

I am not knowledgeable in infringement law, and had NO clue what avenues i could take, if any.

Thats it and thats all.


Thanks for the photos comment, they are turning out to be more trouble than they are worth however.

I didnt post said photographs anywhere. I think my computer was accecssed from the outside...not the first time....and i have a ty firewall.....but not after this drama.....


of course they are my photos.......i'd be what im accusing somebody else of otherwise----a bunko-artist!!!

wtf is wrong with you people .... ever hear about contracts and liability ie/ the contract pdiddy had that only one photographer allowed on stage to photograph him, etc. due to the pictures being stolen or misplaced one can encounter liability suits in the process

big ups to you keep ur fingers on the telephone digits for a lawyer cause anything could come of this and i would do whatever i could to get some sort of infringement suit going as well.

you guys are all ridiculous and missing the point.

that i am a nightlife photographer......it wasnt to the gentleman that stole the photos, when i emailed him telling him to remove the photos, i also added my myspace address, so he could see that i in fact do this for a living.

So i guess he figured linking my site, would make a difference

that is complete bs when you say someone accessed your computer and stole the photos. I would not believe that in your case at least. You sent it to someone or you posted it on your myspace and it was taken from there. Good luck suing them if you are going to, the most you will get out of it is them taking the pictures off their site and costing you hundreds of dollars if not more. You are a nightlife photographer and you should know better, in this case those pictures could affect pdiddy's career and its not professional to spread photos like these around and then trying to sue a site for being careless yourself.
