Got Sued for about 330K ... shockin amount ... Need advice

About 2 years ago, when I was a stupid teen I got into an accident with TTC. I was fully at fault since I failed to stop at the stop sign and due to bad timing a TTC bus was just passing by in a perpendicular direction.
In the result of the collision my dad's 2003 Accord got ride off. I could have died since the bus hit me from the driver side, many called it a miracle that I was 100% healthy. However someone in the bus was apparently injured and was taken away by paramedics.
I really thought that the crisis was over till just now that I received a "statement of Claim" in which the plaintiff claims against me, my dad, TTC and the bus driver for:
- the sum of 750K for general damages
- the sum of 250K for special damages
- prejudgment intrest on all sums awarded from sep28,1999 to the date of payment or judgment pursuant to the provision of section 138 of the courts of justice act, 1984;
- their costs of this action; and
- post-judgment intrest on all sums awarded from the date of judgment herein to date of payment pursuant to the provision of section 139 of the courts of Justice Act, 1984;
I have 20 days to defend this claim and I should react soon.
And I really am horrified at the moment :nervous: and absolutely hate myself for what happened, however I wanna deal with this myself and I need some help and advice.
Basically any input would be appreciated. |

I assume you had liabilty insurance?
Assuming you did, then let the insurance company worry about it. That's the whole point of liability insurance ;)
and the insurance company will fight tooth and nail to avoid paying anything.
also, unless the injuries were very severe (ie broken limbs, permanant disabled etc..) then the chances of them actually getting anything close to that amount are non existant.
but ya... call a lawyer for advice for sure. |

and another thing... if they were able to take you to court.. no court is going to actually put a million dollar judgement against a kid. this isn't the US. they take into consideration the basis for the claim and what the person being sued can actually afford. The average person probably makes probably just over a million dollars in their entire lifetime. it's not reasonable to expect that they should work their entire life and not recieved a cent of what they make.
but ya... hopefully you had liability insurance ;) |

| As activate said check for liability insurance, and talk to a lawyer so grab the yellowpages and start calling.. I know a lawyer but i dont know if he deals with any of this kind of stuff. |

I'm no expert or anything..... but yeah this obviously does seem shocking and scary at first, but i think it seems a lot worse than it actually is
first of all, as mentioned before, isnt the point of pay $xxx amount of dollars a month of car insurance so that you dont have to deal with this sorta thing personally when it happens
second of all, obviously contact a lawyer because they can obviously give you much better advice than any of us can
and third of all, the $1m claim or whatever is obviously unrealistic, otherwise you woulda probably got this lawsuit right after the thing happened, also see if they are allowed to sue you 2 years after the fact..... i am guessing this sort of thing would usually be settled out of court for a small percentage of what they are actually asking for
btw i dont actually know what i am talking about, i am just using common sense more or less
but first thing to do is talk to a lawyer |
