I don't believe that making an AB claim has any effect on your rates. You may want to check with your broker to be safe; however, my understanding is that it's only at fault collisions that effect your rates (from a claims standpoint anyway).


Okay, so your friend was at fault... you have a right of action against him. I would recommend that if you want to claim for your lost income and injuries you put his insurance company on notice as soon as possible (because once you do you earn interest on anything they owe you).

Well on the police report he wrote down that he hit black ice or something, I gotta try to find the police report, also I would need the hospital report from the doctor.. I'm so lost in all this :( And potentially losing a friend while doing it too, what a mind screw. Thanks ChemEnhanced and Moral Hazard for the advices, if you guys can provide any more help it would be greatly appreciated.

Hitting black ice is not a defence... any reasonable person would have known that was a possibility and would have taken appropriate precautions. He will still be considered negligent. If you have questions regarding AB chem is your man, regarding Tort I'm the one to PM. If you send me further details on your injuries, income, and time off work I could give you a better idea what you could expect in terms of a BI settlement.

Can I sue my work for new shoes?

They transferred me here and now all my shoes are ruined with salt and walking to work.

Sorry Rachel... the transfer would be a remote cause... your failure to wear boots/toe rubbers would be the proximate cause... the only negligence here is yours. You could always fake a slip and fall then use the settlement to buy new shoes.... real nice new shoes!

You could however try to start an action against the Vatican as it was the actions of God that caused your shoes to be ruined.
