I just got one of these tickets and was wondering if they are legal...I remember that the city of Toronto was fighting the right for private companies issueing tickets but I've lost track of what was going on with....They are the blue parking tickets

ANy ideas?

it's illegal. Look up the bylaw on the city hall website. Call them and site the bylaw number and they should just remove the ticket. They operate these days mainly on ignorance.

Also Impark is not yet up on the credit card scam. You are still able to use a canceled or a unactivated card in there machines to get free parking.

The use of a revoked or canceled credit card is contrary to the Canadian Criminal Code section 342(d).

I dunno Jay :(....I am getting conflicting info from various online sites as to whether or not IMPARK has the authority to enforce the fines by harrassing you through credit collection agancies...

SO any links to the right info would put me at ease...

Let me try to dig up my post about it
Jayx1
Here it is:

Just to let you guys in on a little scam that is going on within the city of Toronto.

I parked my car yesterday at an IMPARK lot for half an hour. I had taken my ticket at the gate and then paid for it as i left with a LIVE attendant. While i was inside i recieved a parking ticket from IMPARK for $40 for "improperly displaying tag". Essentially they were trying to tell me that the tag was upside down.

What are the laws and what did i do about it?

Well after several phone calls to the bylaw dep, city clerk, and finally Toronto Police Service i was informed that the private issued ticket was not valid. I was told that SOME private operaters are police certified. However, these tickets must then have a Police or city logo on them and information from the city. Also you must have contrevened an actual city bylaw, not a made up one by property owners.

I was also informed by the police that although they threaten to take you to collection, they rarely do due to cost. Also, they cannot arbitrarily tow your car the next time you park there. They must have permission from the police otherwise it's theft.

So i called IMPARK itself. I informed them that this ticket was in violation of Toronto By-law 540-2005 and they promptly "cancelled" the ticket no questions asked.

Just a warning to anyone else who gets caught up in this scam. DONT PAY THE TICKET!!!! These people thrive on the ignorance of the general population because the ticket looks very official. All it is is a cash grab!!! (well so are municipal ones but thats a different jerry springer show!)

This is what I found regarding TOronto by-law "540 2005"..

"540-2005.... To amend further Metropolitan By-law No. 32-92, respecting the regulation of
traffic on former Metropolitan Roads, regarding Chatsworth Drive, Eglinton
Avenue West, Lawrence Avenue West and Steeles Avenue West."
The Ear
Either way, don't bother paying them & see what happens.

And then please report it back here.

I seriously doubt they have much if any recourse as a private agency, and if they do put a collections agency on it, tell them that they're calling your friend's phone & redirect them to your new number (and be sure to use one of Impark's numbers) for future calls as you won't be paying anyway. This will at least frustrate them further. Then after pissing them off immensely, go Jayx1 style on 'em.
