I've been reading movie news daily for years and I can tell you that this has not been confirmed at all. The director is on vacation at the moment and hasn't even started to write a script and there is no start date for that planned either. This movie is at least 2, probably three or four years away!
The studio can muse about getting Depp and Hoffman all they want, but keep in mind director Christopher Nolan has said a few times he doesn't like the character of the Oswald Cobblepot/Penguin and won't use Catwoman either, but would rather use more obscure villains not previously seen on screen. The Riddler still gets mentioned in serious speculation, but that's all it is at this point. |

RUMOURS NOT TRUE
MTV's getting around at the Toronto film fest!
A few days ago, Michael Caine 'confirmed' to the net that Johnny Depp and Oscar-winner Phillip Seymour Hoffhan were part of the next Batman film's cast.
Well, Phillip Seymour pulled the net aside on Tuesday to deny the 'rumor' that he'll appear on the big screen as the new Penguin.
In fact, the talented thesp told MTV that he'd be a horrible Penguin:
“No one has talked to me about it ever — never,” replied Hoffman. “It happened, like, five years ago, too. It was a rumor back then and it’s still a rumor. [laughs] It’s just in the press. It’s funny.”
To further cement this issue, Hoffman added that he’d never met Nolan (”Maybe I did or met him in passing?”), and that his interest in comic book movies is purely on a fan level, and he intended to keep it that way.
“I’m such a fan of those movies,” related Hoffman. “Comic book movies in general I look forward to — I am a real cheerleader for them. I want them to do well because those are terrific stories. As a kid I was a big comic book collector. What [Nolan]’s doing is taking it in a whole other exciting great place. I’m more a fan, so the interest of being in it isn’t that great. It’s more the interest in wanting to see the next one. It’s probably better that way.”
When further pressed for his level of interest if Warner Bros. approached him about the role, Hoffman said, “I don’t know. I think I’m more interested in seeing someone else do it. I don’t know if I’d be a good Penguin to be quite honest. [laughs]”

He could be lying that he has the role as the Penguin, but it doesn't seem like it's true.

Nothing has been confirmed.
Just rumors...
Just ask DJ Smitty. I have a few Movie News Feeds that I look at nothing has actually been confirmed.
Offers may have been made, but nothing has been signed...
