Can cell phones be transfered wout owner?

I want to buy a phone, I'm told it was "found", but I'm not sure. I don't want any headaches. Is there a way to change a phone from someone else's name to mine with out having consent from the original owner? I thought once a phone was registered to a person that it couldn't be used by another without some tech support from the service provider. Any help would be appreciated.

Phones aren't registered to anyone. The SIM chips are. Switch out the SIM chip, and it might, might work.

unless it's CDMA then if they blacklist the phone you're screwed.
