one time i was driving on 407, it was early morning and i was driving to work on a saturday, i was driving in the left lane when i realized there was something on the road very far away, at first i thought it's nothing so i kept driving in the lane , i thought i'd just run over it or w/e it will be fine, as i was getting closer to the object it became much bigger than it seemed at first, so i'm like w/e i'll switch the lane to the right..as i approach it i realize it was a huge ing ladder that fell of a construction truck. WOW if i ing ran over that thing i'd probably be dead by now..

Alright smart guy... this is a single vehicle accident... meaning the only person involved is the driver of the vehicle... who was negligent; subsequently, at fault?

Technically that's still an at-fault collision... but most insurers don't treat it as such... of course you already know this.

I know...they should never have changed it to a comp. claim from a collision claim.....but I can see how in some cases a driver would not be able to avoid a collision with a deer.

Question though, why the hell did you waste money on a tow? It sounds like the car was drivable?

It wasn't drivable.

It does not matter... you are responsible for paying sufficient attention and driving with sufficient care that you can avoid collision.

Because 1) it was dark outside and 2) the piece of debris was black (or some other dark colour) I was unable to notice the obstruction until it was too late for me to avoid it.

In addition, there were cars passing by me in the adjacent lanes and, so, if I had swerved violently I might have collided with another driver.

Respectfully, I don't appreciate your condescending tone MH; it's unnecessary.

yeah you're pretty much out of luck. i totalled my car when i hit a deer which was impossible to avoid but still had to pay the deductible. i also had a huge tree branch fall on my car during a storm and had to pay the deductible. clearly not my fault other then the fact that i was the one that parked under it.

Ugh ing car insurance. Legalized extortion.

sorry that had to happen to ya :sadgreen: ...my buddy ran over a truck tire and it got lodged underneath his bmw which was lowered and it made his car loose all control ended up in teh ditch. He was so lucky he was not paralyzed. It took him like 6 months to recover with a neck brace. I think the only thing you can do thank the lord your alright.
I do have to say some of these truck drivers don't give two s and aren't held responsible for tires/scrap off their truck. If i see this i am going to get my camera take a picture of his plates with everything and report them.

If you want to call someone a retard, at least learn to spell so that you don't look like one. It's you're.
