they got undercovers outside the area too. for ultra 5 i think it was, when it was still at bayfront park (same neighborhood), we went to bayside before ultra then went back to the car to smoke a bowl before we went in. i had to pee so i went into an office building across the street when i came out they had my two friends out of the car with all the car doors open and they were searching the trunk. apparently what happened was some undercover came up to the car and asked "hey, know where i can find any candy?" right when my friend was packing the bowl. my friend looked at the cop, said no as he tried to hid the bowl under his hands and under his shirt. the undercover then said "hey, whats that?" and my friend said nothing. the cop then flashed his badge and that was it. they searched the car, charged both my friends with possession of marijuana as well as getting charged on two different counts for the whipits and the whipit cracker in the trunk. luckily though it could of been a lot worse. they had pills on em as well as like a ing ounce of opium. but somehow the cops never found that. and if i wouldnt of had to go pee so ing bad, i woulda been caught up in that whole mess.

generally that how it works. problem is you spend a lot of time doing that. and then it may happen that they dont have enough to give to you or whatever. i dunno. good luck though. |

No, that isn't automatically entrapment. If it were, then female officers could never pose as prostitutes... but they can, and do all the time. Undercovers DO pose as dealers sometimes. Arguing entrapment -- and winning -- is difficult in most cases. If you go up to an officer posing as a dealer, and you ask about drugs before he offers, you've basically thrown away any chance at that defense. Even if he makes the offer first, though, you'll still need to show that he "induced" you to do something you were not "predisposed" to do. This means you'd have to act reluctant, and he'd have to keep badgering you to buy until you gave in.
However, they are far more interested in catching dealers than potential buyers, so they're FAR more likely to pose as buyers. |

Very good points indeed. Thanks for the correction. I didn't think about prostitution that way because "Attempt to Solicit Prostitution" is a charge whereas I don't know what it would be for drugs. What is the charge they can hit you with then? Attempt to purchase narcotics? |

In Florida it's "Attempted Purchase of [substance name here]" and carries different penalties according to what substance it is. |

oh yea! there was another friend of mine with us as well, but she barely smoked at the time and didnt wanna risk it, so she waited for us across the street. she knew better i guess.
