Is there not a small claims court type setup?

Civil lawsuit seems a little OTT for landlord/tenant issues.

since the landlord - tennant relationship is regulated by legislation, you should follow the appropriate steps outlined in the landlord tenant act before resorting to civil suits. this is the cheaper way to do this.


remember if you try and sue your landlord and lose, they can counter sue to recoup their legal costs, then oyu have to foot the bill for your lawyer and their lawyer

YAY! Real responses.

We already know that we would win no matter what happens. She has practically broken every law possible as a Landlord (entering our premises without permission, not providing a Notice of Landlord, not completing an inspection, trying to enforce lease amendments months after the beginning of our tenancy that were never agreed to, trying to enforce a rent increase only a couple months into our tenancy, turning the heat to a temperature well below the legal limits, threatening us, etc.etc. *oh yes, there is more*), and the lawyer we spoke to literally laughed (I am not kidding) at the $hit she's been trying to pull on us.

astroboy, I really appreciate your comment. I will admit that my knee jerk reaction is to want to take her to court and sue her ass off because I am just outright pissed off. With that being said, we don't want to have a long and dragged out process where we are paying a ton of money, and we certainly don't want to come across as angry tenants seeking revenge.

We have made formal complaints with the government and they will be launching an official investigation. We are going to wait to see what comes of that, at which point we will make our decision. Either way though, we are almost 100% positive that we will be forced to take her to court to get our security deposit back because something tells us she will try to withhold it.

*sigh*

She has been a nightmare to deal with... I will be soooooooo happy to move the hell out of here.

for the record security deposits are illegal in canada. landlord's can request that the last month's rent be paid up front, but he/she has to pay interest on that sum over the course of the tennancy.

Which she told us at the time of signing the lease that because we weren't staying for a full year, we are not eligible for any interest.

The woman is a total bitch.
