Where are you folks getting your information from re: potential jail times, fines, etc for marijuana possession and/or trafficking?
Possession of 30g of marijuana or less is a summary conviction offence which carries a maximum penalty of a $2000 fine and/or six months imprisonment. In practice, possession of small quantities is very unlikely to lead to jail time but imprisonment is a definite possibility and the attainment of a criminal record is probable.
There is no such thing as a designated fine for marijuana possession. Under the proposed 'decriminalization' bill introduced by the previous Federal Liberal government, the Contraventions Act and the CDSA would have been amended such that possession of a certain amount of cannabis would result only in a monetary fine under the former act and not any kind of punishment under the latter (although there was a gray area in the bill wherein it was unclear whether it would be possible for one to be held criminally responsible after having received two previous violations under the Contraventions Act). This bill, however, died when an election was called; under the Tories, the legislation (as one would suspect) has and will not been reintroduced.
The bottom-line: Canadians are still being criminally prosecuted for engaging in an activity that i) official stats tell us three million Canadians participate in every year and ii) opinion polls have shown time and time again the majority of Canadians do not believe should be dealt with via the criminal law. Furthermore, two separate special committees (one under the HOC, one under the Senate) created exclusively for the purpose of investigating the question of how Canada should deal with cannabis concluded unambiguously that reform of the system of prohibition currently in place is required. |

im pretty sure trafficking any quantity could lead to jail time. its only possession under 28 grams that is a fine or something like that. |
Both of you are wrong. Possession of any amount is punishable under law. The laws were never changed, bills were introduced, and dropped. Cops were also told not to bother with small amounts, but it was never the law. When the Conservatives came into power, they put a stop to all the leniency, and actually introduced bills to increase penalties for trafficking.
Does anybody know what time the actual parade starts? I missed it last year, and my friends have never done the actual parade part. I did not see it on the website (which is just horribly designed btw). |

• Replace the current criminal court process and resulting criminal penalties with alternative penalties for possession of 15 grams or less of marijuana or one gram or less of cannabis resin (hashish);
• Provide law enforcement officers the discretion to give a ticket or issue a summons to appear in criminal court for possession of more than 15 grams and up to 30 grams of marijuana; and
• Provide for greater alternative penalties when aggravating factors are present, including possession while committing an indictable offence, while operating a motor vehicle or while on or near school grounds;
• Create new offences providing tougher penalties for illegal growers. The larger the operation, the greater the penalty, with a maximum 14 years in prison for anyone found with more than 50 marijuana plants. This is double the current maximum penalty of 7 years.
I want de-facto decriminalization ... we were so close in 2006 then the ing conservatives took over :( |

I want legalization, whereby cannabis is regulated and taxed similar to other goods, such as tobacco and alcohol. |
Fixed :) |

Yeah, I tried looking it up myself and couldn't find any info.. and it figures it would be badly designed, we're dealing with um, "marijuana enthusiasts" here.. you can't expect them to remember EVERYthing.. like parade starting times.. minor details ;)
I sent them an email asking for more info on that though, so if I hear back from them before I leave tomorrow I'll let you know.
BTW I guess this is my RSVP to the event.. add me to roll call, please :D |
