I'm not sure that's very practical advice for someone with an anime character as an avatar :) (not that there's anything wrong with that, I'm just assuming you're a teenager). Registering a trademark is a few hundred dollars and talking to a lawyer is also going to cost money unless they're a family friend or something.

I really think you're probably getting ahead of yourself--unless I'm wrong and you're out there already releasing tracks. Trademark infringement doesn't become an issue until there's enough money at stake. Remember how long the dubstep Plasticman got away with using Richie Hawtin's alias? I think he needed to get a Radio 1 show before anyone really told him to change it to The Plastician...

i'm not sure if you are referring to me. however, i've filed for plenty of trademarks and the cost depends on how many categories you are interested in filing. also, consulting with an attorney will cost you a couple hundred bucks.

i'm not a teenager. i'm probably older than you and that is one of Border Community's logos. you should know that label, if not, then it's james holden's label.

i don't know if the guy is getting ahead of himself or not, just suggesting constructive points since i'm experienced in the field. similar to asking you what does it feel to be retarded, i'm sure you'll be able to demonstrate us a few things on that.

Then you'll be the first, no musical artists have actually used that name for music.

Tiesto stole my name, he also stole my virginity.

Woah I'm sorry DJ_Lord--I totally wasn't referring to you as having an anime-avatar ( I was referring to the thread starter). I know that's border community and I've been reading your posts for like, 6 years now.

I really didn't mean to offend you. All my comments were directed at the thread-starter. I understand that everything you said was completely legit advice--I was just (maybe unfairly) thinking that the thread-starter was like me when I was younger, and wondering about all the trappings of DJing/producing, before remembering to focus on the fundamentals. For the record though, (and this is so ridiculous, but whatever), I am older, and I'm not some kid who thinks he knows about trademarks from reading wikipedia or something. I'm an IP attorney, heh.

i love how some people actually care a lot about this kind of stuff, yet have still not done anything to make anyone give a what they are called.

hint:start by putting something out of note because no one gives a what you call yourself until you have actually done something.

So I came up with a unique name for my artist name. When I typed it in youtube however, there's one video of another artist going by the same name performing a liveset in 2007.
I searched on google and he hasn't released any sort of tracks. I saw his myspace music page and he just posted a snippet of his liveset.

Am I allowed to still trademark and use the name as an artist?

Well what the is it?
