I'll share what happened to me in June at my parent's house. I had a passing the bar party. Police entered (a sergeant) and his partner. I went up to them (I was pretty smashed), yelling about not having a warrant absent exigent circumstances. They were already speaking to my father. They basically told me if I don't back off I will be arresting for disrupting a police investigation. So I walked away.
They gave my father a notice to appear. We appeared on the date. They charged my father with 3 misdemeanor, however the deal was to take 1 infraction and a $25 fine + fees. (came out to $179) So it wasn't worth it to fight 3 misdemeanor against my father so we took the deal and called it a day. I have a feeling they purposely sandbag us like this so we take the deal.
I know LA is fairly broke and is going after petty offenses. I thought that was pretty petty. I've even heard they have been giving tickets for pedestrians that enter the crosswalk after the hand starts flashing (even after a second or two)
Good luck. If you/they weren't charging and they have no evidence that you were charging, I don't see how the prosecutor will go ahead. Police may recommend charges to be filed, however the prosecutor must file the charges. In LA city, the district attorneys office handles felonies and the city attorney prosecutes the misdemeanors. |

Relevant to the quote. The event was open to the public, regardless of your "member/invite only intentions; because whether they were your people or not. There were at least a dozen times where people were shouting out loud "Tiesto Afterparty - Dance Democracy" followed by with whatever details they were sharing.
Especially during the exiting hour of this event. That alone makes your event open to the public. If those weren't your people shouting that out loud, it's still your fault for not having control over the information being given out for a suppose underground event. It doesn't even matter if you intended your invite(s) for 1 person or 1000.
Now given what I just told you, this situation could have been much worse. At the very least, you had ways of identifying who was involved: badge numbers, etc etc. All of you are lucky some gangsters didn't find out about this and crash your party. Just imagine what those results would have been like? Robbery? Rape? Violence? All 3?
I get it, what happened is messed up and I can only assume the police broke some laws, but I wonder.....
1. If you're party was so exclusive, why was it all over the internet? The best underground promoters in the bay NEVER use the internet to any degree
2. The Cow Palace is notorious for having a vast police and undercover force on site. Promoting your underground here was probably the stupidest thing you could have done.
3. I would never invite strangers from such a massive event to my house, what did you think was gonna happen? People show up and the tanner family vibe was gonna be activated through some magical redundant noise?
You probably didn't deserve what happened, but it's absolutely clear you didn't set yourself up for a safe and successful night. |

d00d, I don't ever jaywalk down here because I got citedf or it TWICE, an hour apart, in 2002. Maybe it was 2001. I about crap my pants when I learned I could pay like $500 for EACH offense in some cases. In the end, I had to pay like $240 for both. Mind you, I hate when people cross streets right in front of cars, but this was in downtown LA, during night, probably no cars within a couple blocks...other than the cop that I didn't see...both times.
I think they were looking out for it. Had to be! I was actually always warned that I could get a jaywalking ticket more easily in LA....and damn they were right! |

Was in court yesterday to support the other Dj's who had their laptops illegally impounded. Thanks to the Electronic Frontier Foundation (EFF) they got all their equipment back. Big ups to Granick at the EFF for winning this case and fighting hard for all of us.

Hopefully now that the DJ's have their property back they will file complaints against Sgt. Larry Bertrand star#414 and the SFPD so that he and his "task force" will stop all this nonsense. I know how it is once you get your property back you feel like it's all over and the fire inside to fight back dwindles away. But if Bertrand doesn't get complaints filed, he will continue with his illegal practices unpunished.
We still need more letters. I think we have about 5 now. |

Good luck to you guys!! I hope (for all of our sakes) you win this battle.
Please take from this experience a better way to organize and plan you upcoming parties. I know i have learned (and paid) from all of those prior mishaps and I know you will you too.
