Looking at the statute, it's hard to see how the court could have come out any differently without giving the FCC are carte blanche to regulate whatever it wants, however it wants, as long as it has something to do with the general policies of the Communications Act.
It's short-sighted to think that would be a good thing merely because you happen agree with the current policy objectives of the FCC, because a contrary ruling would have given the FCC the same kind of boundless discretion going into the future, when it will likely shift back to the conservative side of the political spectrum. Would you want them to have carte blanche then? You can't have your cake and eat it too.
What really needs to happen is that Congress needs to get off its ass and solve the problem legislatively, rather than relying on an agency to run off and do it on its own without any legal authorization. |
