He's making a good point though. How can they arrest him for driving under the influence of alcohol withoutconducting either a field sobriety test (lol what a joke) or a breathalyzer test. Sure, suspicion of driving under the influence, that they could arrest him for (if it is a punishable offence), but without having done the test prior to the arrest, I'm having hard time seeing this stick up in court. From what I've gathered, the US justice system loves their protocols and if an officer has made a small error during the arrest the case gets thrown out.

Some states can detain you and force you to give a blood sample as a sobriety test. I thought the one cop mentioned a blood sample and implied consent.

In Washington if you refuse a breathalyzer test during a stop you lose your license.

I think you'd lose your license if you'd refuse to do a breathalyz0r test in Norway too. But why would they detain you to do a blood test, in whatever states they do, instead of using a breathalyzer? It's non-intrusive whereas a blood test will break your skin, and also they TAKE your BLOOD, not that it's really a big deal, but it's still something they take from you that you'll never ever get back, plus I wouldn't be surprised if they used pretty much untrained professionals for stuff like that, and they probably use AIDS needles on people who's pissed them off. Also a breathalyzer costs ing 5 dollars and they are pretty much reliable. There's a greater chance of a false positive (from inhaling evaporated wiper fluid etc) than not reporting a positive. in Norway theyve been using like a ing stick with a wire they put in your car for a second and it'll tell you if there's coke, heroin etc particles in the air of the car. An officer not carrying a breathalyzer in his car should not be able to arrest, or detain -and i mean as in take 'down town'-, anyone suspected of a DUI. Call it in, wait for a guy with breathalyzer. It will give you a ing number you can put on a paper and admit as evidence, and is a hell of a lot more reliable than an officer, who is a human and so much more prone to err than a machine. I dunno.. it, one more hit and it's good night... Gotta get up early cus the guy who was supposed to be here tonight with the fire wood won't be here till 930 tomorrow omg. I ing hate winter.

Until they find out that blood tests aren't exact enough, so they have to start tapping your spinal fluid to see if you took acid 15 years ago, and then they go for the frontal lobe of your brain, because fatty acids from the metabolization of THC is stored there, and then its this and that, and I've seen this thing go down a thousand times before.

I wish I had visited the US pre-Bush Jr. :(
