There's no basis in the Constitution for this to be struck down. The founders even supported individual mandates in matters of insurance, having enacted 3 such policies. If this gets struck down then it'll be political in nature and nothing more.

| So the liberals get their individual mandate, which, even if it survives the upcoming election, will fail to achieve its intended purpose and which may very well prove irreparable in light of the constitutional restrictions introduced by this decision. In exchange, there are new and meaningful restrictions on the federal government's powers under the Commerce Clause and Spending Clause, achieved in a decision that liberals will loathe to repudiate later and under the guise of an at least somewhat nonpartisan decision.
