Friday 167: Let's Bypass Summer edition

Happy Friday 167, fellow wh00r3s. Can we please to be skipping the remaining summer, yes hello? The first summer heat wave arrived this week, and although it's not "Texas hot" here in ye good ole Land of Dixie (TM), it's hot enough. The heat index for Nashville was 108F yesterday, and I'm fine with it not going any higher. I'd like to make a motion that we bypass July and August, and go straight into September.

The wife finished her radiation on Tuesday, and she has a PET scan today. She isn't scheduled to meet with her oncologist again until the 25th, so they may not shared the results of the PET scan until that time, even if they have the results "read" well before then. A couple of local churches have recently made donations, and that's helped to cover her health insurance premiums for two months, which is a welcome relief...as her employer terminated her from the payroll a few weeks ago but claimed she "quit". Employers are odd...in this case, all they had to do was point out she was "PRN" and therefore didn't work enough hours to be covered by the Family and Medical Leave Act (FMLA). But, no, they go about it all asshat-like to try to avoid paying out if she files for temporary unemployment with the state.

In any event, that's the latest. We're relieved and grateful that she's made it this far. Now we nervously await the results of today's scan and hope that the chemo and radiation did their jobs.

Nothing but yard work on the horizon for the weekend...in this weather, you can see and hear the grass growing.

When is August rolls around, I keep saying to myself that I can't wait for September cause NFL and College football start up then. plus by then, everyone partying along the jersey shore is pretty much burned out.

ever since i moved into my grandmpa's house i been averaging like 3 hours of sleep a night, i got better sleep when i was living on my own which is weird because my apartment was literally the size of a closet...i guess i was able to rest better at night knowing i had freedom and i was progressing in life..and this just seems like a step backwards....anyway i am at work right now with a pot of coffee going to try to find a wifi hotspot to catch some of the world cup action on my break

Our heat wave broke last night. Mid-high 30s,felt like low 40s some days with the humidity. I was enjoying it except for not being able to take the baby out in the middle of the day.

Gym tonight. Whole lotta nothing else this weekend. Just get out and enjoy the sunshine with the fam. :)

We've had no rain for months here. Every last blade of grass is yellow and dry as straw. It's been a heatwave for two straight weeks, and I was in Spain for a week before that. Can't believe it's only the start of July.

Anyway, I'm sat in a beer garden in a leafy neighbourhood making the most of it. If England win tomorrow this might be the best British summer ever.

I'm really sorry to hear that and they're s for behaving like that. Not sure what state you're in (and chances are if you're in a southern red state then there's likely not too many protections) but you may want to look in to filing a claim with either your state employment board, or DOL; You can't terminate someone becuase they're pregnant/ill/receiving treatment etc - the federal statues are clear on this and it's UI fraud to list her as having quit to try to avoid her claiming UI. It's also really stupid as they have to pay in the UI fund by law (it's not like they ever get that money back) so her claiming actually costs the company nothing (it's a myth that people going on UI cost a company - it only happens in cases where there's large scale layoffs which drain the UI fund etc).

Much as I hate the punitive, litigious solution of going legal as every person ever let go from a company tries to pursue, but speak to a lawyer and think about filing a claim, If they act like this, I imagine there's all sorts of payroll/wage violations going on.

I think a lot of companies behave this way because they know they have the resources on hand to defend the litigation and that most people do not have the resources on hand to even begin the litigation...or knowledge of their rights in the first place. I am just "lucky" because I did my management concentration in human resource management during college.

who else loves jagermeister? tell you man, something special this digestif. its sweet but never have I seen sugar caked around the lid ever, feels great after a meal or just whenever. Minus a beer here or there seldom, its all I've been drinking.

Not here in Cali; It costs a business a small fortune to defend themselves against a wage claim and a plaintiff absolutely nothing to file with a no-win, no fee lawyer.

If the employer goes all the way to court, and wins, legal fees aren't recoupable.

That means it will cost anywhere from $30-100k to defend yourself and if you win, you get nothing in return.

I know a large firm that caught an employee dealing hard drugs in the office. Red handed, on camera etc. They obviously fired him, even game him a months pay to leave and he signed a claims waiver in exchange.

He sued them for wrongful dismissal (even though he'd waived), had no case, but it was going to cost the company $50-75k to get it dismissed in court.

He was asking for $25k, and the CEO got wind of the situation, made a business decision and paid out.

it was cheaper for the company to settle and pay, rather than go to court, win and get nothing.

Probably not the same in other states but defending litigation is expensive. Just to file a rebuttal claim and go through initial discovery is going to cost $20k. Depositions? $5k each. Arbitration? $4k a day.

Except in class action suits worth millions, most companies will not pay out to win a case that's going to cost more than settling it for a few grand.
