Anyone know the law?..... Good?

Allright I have this buddy of mine, who was at a top 40 night club on saturday, and he def. had wayyy to much to drink and frankly being a re-ject (he has since decided not to drink anymore)....the bouncers asked him to leave and he got into a confrontation on the way out, he threw the first punch and then faught the bouncer, he did fairly well for being that drunk...all was allright untill the rest of the 4 bouncers came outside to the rescue, and proceeded to boot the kid and basically assault him for at least 10 minutes, now the kid at that point was so out of it from so many shots to the head, that he was basically fighting to stay allive... he was yelling and trying to hit back(us as friends were being held back, but we were tryin to help him), but it was rough...they did a number on him and def. exceeded there boundries as bouncers, then, another bouncer came out with a Video camera, were he proceded to transfer the footage onto the big screen in the club itslef!!!, the manager came out, told them to stop filming for a mintute...Kicked him straight in the head (in people can die from kicks like that!), then told them to start filming again....this is in horrid, my buddy was in the wrong, and admits it(if not for his girl being there and going crazy, tellin him just to lye there, so they would stop hitting him, he proly wouldnt have made it)...but they went way to far on a 160 pound 5ft 11in. person. Everyone is telling him to sue the out of them.

I was just wondering as far as a legal stand point, were does he stand??, since he did primarily start it, can he do anything...??, Is there a chance he could get charged if he takes this to the cops...??He does have a severe concusion, cut up head, brusied face, black eyes, and broken ribs...

any legal info would be much appreciated, thanx ahead of time.

oh yeah, this is really bad and your friend can do something about it with tribunals...

plus there was so many witnesses...

first thing first, do a police report, they will check his injuries and note all about it.

cdn lawsuits take AGES!, I MEAN AGES!

pathetic they are

call the cops, reasonable force was exceeded, funny how boucners think they are above the law. You can press charges if you want..let the cops deal with it first then think about going to civil court to recover civil damages for pain and suffering. They can take a long time tho, remember this is Canada and our courts are back logged.

yes he can sue. bouncers are only allowed to use force in self defence to netralise the situation. if your friend can prove that even when he was no longer a threat to them they continued to hit him, he can sue them.

This is probably a stupid question, but what country did this occur in? The law varies from country to country, so an American might give a totally different answer to say, a European.

get a good lawyer that makes a world of difference





if what you say is true, then you have a very valid case.
plus you said they put it up on the monitors at the nightclub?
find witnesses and get the tape immidietly
file a police report
you can sue them for them puting the beating up on the main screen alone.

although i know all about law, i'd say ur friend has a load of money comin his way (assumin that ur tellin the truth)

In Dublin about 2 years ago, a software engineer in in a bar and he was pretty drunk, he ordered a drink, and a bouncer came over to him and asked him to leave.

then the bouncer twisted his arm up his back, pushed him head first through the door (using his head top open it). then he threw him to the pavement where the guy smacked his head off a pillar and fractured his skull.. if he hadn't been rushed to hospital he would've died. he spent over 9 weeks in hospital.

the bouncer has been given about 2-3 years in prison.

the programmer guy was just a normal little guy. the bouncer was a in tank.

the judge described him as "putty in the bouncers hands.."

Wow that all sounds sooo familiar to me. A friend of mine and more so of my brothers had pretty much the exact same thing happen to him. When he went to the police after a few weeks they got back to him and said, "the cctv camera was pointing the other way. sorry not much we can do." Of course he weren't gonna let them get away with this, so took the law into his own hands. Let's just say that bouncer will never be able to work as one again. :eek: Not that I condone that sort of thing, but whoever said above that bouncers think they are well above the law is spot on, and they often go to far.

Depends on the country and the security laws, In the UK, most Nightclub bouncers need a licence and do not have any crimamal convictions , I have best freind who is a bouncer and he has been in lots of situations like this, your friend could claim for assault but the bouncers could claim for self defence also, It also depends on where it happens, if the attact happened inside the club then it would be hard to get a court battle, if it was outside the club premesis then the 'Employee Doorman' Would not be able to claim self defence and would be classed a normal ciziten, also your friend did throw the first punch, i understand your concern about the head kicking , but maybe one punch could knock you out or over resulting in you cracking your skull open. Doormen like violence they are just waiting for someone to around, feel a girls arse or something petty as they get paid to enforce the law inside places where police can't. If your friend has serious injuries then i would employee a good solictor and report it to the cops as assault. If he is ok then id drop it and apologise to the doormen, as if they get sacked and they see him alone one night he will most likely be battered again. My local club has many exits where there are no cameras , they will push you into a steel firedoor at 20mph by 4 big guys and you prob knock yourself out maybe break your wrists and all the bouncers say is that he fell into it coz he was drunk.
