Ticket for Loitering/Hanging Out?!

This happened to me today. Me and my friend get a $50 ticket for loitering. Un-ing-believable.

Story: It may seem long, but please read it :) And give some feedback.

Me and my friend were at the back of a plaze, near a pizza place... we're just standing there, and i pass him my cigarette. Two cops on bikes come up to us and ask us if we have anything on us becuase when we switced the smoke, it appeared to them as a pass of a spliff, aka, drugs. We said no.

They didnt belive us.

They checked us.

Emptied pockets, the works.

They didn't find .

Now... they take down my name and d.o.b. same with my friend. They let us off and thank us for our co-operation.

Now me and my friend thought we were O.K in the cops' books. Me and my friend go to Tim Hortons (coffee place) and bought 2 bagels and sat there and ate.

After we went out for a smoke, and they come up to us and say, "You're still here" as if they told us to leave. Now, they ask us why and we told them we are waitin for someone. We told them that this guy was comin to pick us up. Now, since they are ******s, they said "well, we have to give you a ticket for loitering. "We told you to leave". The sad part? They didn't tell us to leave.

Im gonna go to court tommorow and get this fixed. Its not about the $50. I'm not paying for something that ing stupid. If it said "DO NOT LOITER. IT IS A CRIME", we wouldn't have. But it didn't and me and my friend don't exactly know every ing law in the book.

If that's the case then it's completely stupid!

seem like a lot of cops on your side of the water like to show how powerful they are for any reason they feel like.

sad, very sad.

unfortunately, it doesn't matter if you know the laws or not. Even really strange obscure laws, people are expected to know them (magically of course).

If you go into a store and buy something and then hang out outside the store...how are you loitering? I thought loitering was when you hang out in front of a store but have no intrest in buying anything from it.

I think it's just a case of the cops having nothing better to do in your town...they're really keeping the peace by patrolling your local plaza which i'm sure is a "high crime area"

Good for you, take those pigs to court. What they did to you was profiling, down to when they searched your pockets. They had no right to fine you, you even bought from the establishment. Do what you can to stick it to the man. :tongue2

while i am being a pretty law abiding citizen, i've never understood the power an officer has determining what is loitering and what isn't. anyways, for this, i think it was unjust and would support you in court
