I agree that at some point peoples opinion on other products may change and we will deal with this again. However, there are many things out there right now that are just as harmful as second hand smoke...if not more harmful....and people don't make a fuss about that. The emissions from vehicles are just as harmful as second hand smoke and even more harmful to the environment. In reality we should stop driving all together so we can save the environment and sace ourselves. I don't think any of us will give up our vehicles. The guvernment won't step in and do something because that makes them look bad. |

Only nicotine addicts feel good from smoking because their need their nicotine fix, it's the withdrawal effect. Not the same with alcohol or gambling, you don't need to be addicted to either to feel good while doing it.
Hell the average person feels sick after having their first cigarette, and in contrast pleasantly drunk after their first beer. |

Apparently radon gas and asbestos accounts for a lot of lung cancer as well.
Besides, no one here is talking about how much effect a product has. People are talking about the fact that a product has detrimental health effects. whether its 85%, 5% or some other magic number, this precendent says that you can come up with an arbitrary figure for "damages" and sue. |

Actually, smoking causes a calming and relaxing feeling. Smoking also curves your appetite and relieves stress.
And the biggest benefit is that you get an extra oxygen molecule and oxygen is good for you.

i felt sick the first time i lost $20 at the casino...

but the issue here isnt how it makes you feel, the issue is whether its detrimental to your health. And obviously it is which means the government can now sue. |

SUVs arent critical. Everyone could get along just fine in a GEO metro. So why not sue SUV makers? |

true but they don't band certain types of vehicles or make the automotive industry pay for health care. |

because the government has better things to do than go around SUEING everyone.
There is no comparable argument here.
SUVs were not designed to secretly pollute the environment.
They are not marketed to say that they pollute less than they really do.
And further, SUVs are only PARTIALLY responsible for general environmental damages. |
