hey peeps wondering if anyone can fill me in on the following.
if you have to appear at court for speeding and you hire a lawyer,
do you still have to be present. if i remember right, from being in court one time, it is ok as long as the lawyer is there on time.
if you show up on time and the lawyer never does, the court will not let you proceed without your attorney. can you fire him, what can be done.
two different questions.
any prelaw or law peeps in this mo fo.

Why would you hire an attorney for a speeding violation?
Just pay it and go to traffic school so it doesn't show up on your record. |

Hey, I have a similar question.
I've decided to challenge a ticket on the 11th. My lawyer who has dealt with my tickets in the past is a friend of the families. Anyways, even though he cuts a deal, I'm not going to pay because I don't feel the reason I got this ticket was just.
What are the odds of "winning"
What is the procedure?
Should my lawyer be present with me?
Do I get to present my side of the case? If the officer is there as soon I walk in the door, are my odds already shot?
If I'm shot down, do I just pay the ticket amount then, and there?

+1 it'll cost more money for the attorney than to just pay the ticket.

why would you pay for a ticket for x amount of money (usually almost a hundred bucks or more) when u can just call up a ticket clinic type of place and pay like $50 and u get no points, no court appearance, and no traffic school?
the cops hardly ever show up so without them, it's done. |

daydreamer, totally depends on the state if you need to be there or not, some states it's ok for just the lawyer to be there (easiest thing to do about this? ask your lawyer haha!) - an d you should deff be able to fire them if they dont come on time, if it adversely affects your decision :thepirate
as for YOU estella :p
lawyers are usually reallll good at cutting deals... i would say if the cop comes, youre chances of winning arent THAT great, but theyre still very possible
you should deffff make sure your lawyer comes to your court date, totally key! ;) and you will get a chance to present your side if the story if you like (although hate to say it, it's almost always the cop's word against yyours, youre gonna hafta leave most of the haggling to ykur lawyer haha)
and yes, if you lose, you either hafta pay right there, or agree to a monthly payment plan :sadgreen:
everyone's BEST bet tho, is to talk to your attorney before you agree toa nything, ask them all your questions (cuz all this varies from state to state), and unless youre looking at losing your license or DUIs or something, dont worry about it too much, there's always traffic school :thepirate

Well, I've heard success stories!!!
and it was "wreckless driving" :rolleyes: He assumed I had been drinking, asking how many drinks I've had and proceeded to test my alphabet and give the "follow my finger" test. I've never been so livid, honestly. I was ON MY WAY to the bar. Such is life. So after the tests he goes to his car and does the usual. After his assumption to my mind state, he walks back to my car writing my ticket and he's silent. I'm wondering.. "Well, Mr. Officer, WAS I drunk?" Instead he says nothing and tells me to get my tires rotated. I then proceed to ask, "WHAT exactly is this ticket for?" which I could tell angered him, but everything was so vague and ambigious.
Plus, the direction and road I was heading has been through construction and pot holes are everywhere. I always cross the median to avoid these, of course watching for oncoming traffic. I have a Prelude and it won't handle those conditions. I'm going to take pictures of the windy road with all its potholes plus present my receipt for tire rotation.
You don't think that will work? |

2) I've played that in the past and its worked to my advantage.
3) But throwing myself out there is tiring.
4) He was 45+ and bald and had a slight limp.

In California, a lawyer can not "fight" a traffic vio for you.
If you choose to fight the citation, there's a chance that the officer who wrote the citation won't show up. If he doesn't, you win.
If he does show up you get to present your "version" and then he will present his; don't admit you were speeding. Yeah, that sounds like stupid advice but this is what often happens. The driver says the speed limit was 45, I was only going 50 and this idiot (cop) cites me for going 65. Convicted of speeding by his own admission. Speed limit is 45 and he admits that he was going 50. Never admit that you were driving faster than the posted speed limit.
Instead, try this. "I was driving 33 mph, the speed limit is 35. Everyone around me was driving faster. All the cars were passing me. After I received this citation, I took my car to the mechanic and he checked the speedometer and says the speedometer works fine."
If you lose, the vio goes on your record and traffic school is not an option (in California).

edit: in California, a cite for reckless driving is a felony (major offense). You could get an attorney. Sorry, I missed that. |

let me shed some light on it for you noobs
1. you don't need a lawyer. (if you can afford a lawyer you can pay the ticket)
2. at ur first court appearance you meet with the prosecuter. this is where you can accept a plee bargain.
3. declining a plea bargain will send you to court to see a judge.
4. your chance of winning depends on the appearance of the cop, the judge, and the strength of your case.
