Whenever I buy a product, I ensure that it's satisfactory. Unless the woman's hand nerves are ed for some reason, she would know that it's kinda hot, eh?
It's not like buying an electronic product which might be defective after the purchase and not noticeable at first inspection.
Yes, the coffee was hot. But the woman was also responsible for her purchase where the defect was quite noticeable. |

No ones talking about car accidents.
McDonalds lady never got in a car accident. Her case was directly related to the temperature of the coffee.
You really need to read this entire case. There's a lot more to it than you think. |

Should she have given the coffee back to McDonalds then? Marched in righteously to complain about the temperature? No, because she had probably SPILLED it on herself by that point due to realizing just how hot it was.

| Irishaddict, I agree with you on the coffee case, yet there are many more absolutely frivolous lawsuits that are either won or settled because of the sheer stupidity of th consumer. This is one of them. Xbox not working? Exchange it. How obsessed do you have to be to get so worked up over your malfunctioning Xbox to go the long, hard way of lawsuit instead of just a quick simple exchange? |

That's dumb.
If it's hot enough to give her 2nd and 3rd degree burn, she would have known it was pretty hot when she carried it out to her car. Paper or plastic cup isn't very heat resistant.
Even if she got a paper tray, she would have most likely transferred the coffee to her car cup holder to prevent spillage during her drive, yes? At that point, she would have touched the cup and realize that it's pretty hot.
Having worked customer service, I've had people come back to me complaining that their food was too hot or too cold or whatnot. |

+1...even though the coffee case was frivelous...should coffee only be allowed to be sold cold???Lawsuits like that one represent what is very wrong with the justice system in the US. |
