i know a few people here recently jumped on the myspace bandwagon, hope you read this!

6. Proprietary Rights in Content on MySpace.com.

1. By displaying or publishing ("posting") any Content, messages, text, files, images, photos, video, sounds, profiles, works of authorship, or any other materials (collectively, "Content") on or through the Services, you hereby grant to MySpace.com, a non-exclusive, fully-paid and royalty-free, worldwide license (with the right to sublicense through unlimited levels of sublicensees) to use, copy, modify, adapt, translate, publicly perform, publicly display, store, reproduce, transmit, and distribute such Content on and through the Services. This license will terminate at the time you remove such Content from the Services. Notwithstanding the foregoing, a back-up or residual copy of the Content posted by you may remain on the MySpace.com servers after you have removed the Content from the Services, and MySpace.com retains the rights to those copies. You represent and warrant that: (i) you own the Content posted by you on or through the Services or otherwise have the right to grant the license set forth in this section, and (ii) the posting of your Content on or through the Services does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any Content posted by you to or through the Services.

Owell myspace is probably just a fad. Emos will all finish them selfs off sooner or later...

thats pretty full on, they could start their own record label with the amount of producers who put their stuff up there. not only that, they could have all the tracks recorded under the production alias "myspace". that would be some pretty good marketing.

I believe microsoft has a similar clause for hotmail with respect to anything you send via hotmail becomes property of Microsoft ;)

Most producers i know only have small samples of their work (which would therefore only be the portion that pertains to the licence), but if something is unsigned and on there for that reason, as soon as it's signed all you need to do is take it off and the licence no longer exists.

yeah but it also says that any backups or copies myspace makes of stuff on there remains theirs and they have the rights to those copies. so yeah hopefully nobody has full tracks on there!

but say like the track the artist puts up is already signed - ie Nicholas Bennison has Revention up there - its already on propulsion. Doesnt the label own the rights? so how can myspace as well?

Are they putting up full tracks or samples? It's ok to share samples of your work, thats the way people promote
