Police - Cop - Investigator Issue - Question

I work for a management office in a condominium. A few minutes ago I had a Detective, from York Regional Police, come to my office and asked for some confidential information. He proceeded to tell us whom he was looking for and what the story was (which I did not think was appropriate since everyone is innocent till proven guilty). Then he would not let me finish as why I could not give any information out. THEN he proceeded to say he was not asking for personal information. To make matters worse he says he arrested the last person who quoted the privacy act. He was so incredibly rude and cut me off so many times while I was speaking.
My question is: IS this true – do I have to divulge information to a cop if they ask. How do I know forsure he is a cop – do ya know what I mean?
I don’t have many issues with cops in fact I appreciate a lot of what they have tried to help me with in the past. And if he was any kind of investigator why did he not just check the Enterphone directory board….. |

| afaik if the information is considered confidential/protected they need a warrant. same with any privacy policy. would you give your personal details to anyone who would just hand it over to someone claiming to be investigating them, yet not having enough to get a warrant? |

The Privacy Act doesn't apply since you're not government, but also he can't arrest someone just for quoting the Act.
As a private citizen/private company you can basically do whatever you want in that situation. They can't force you to tell them (without a warrant), but there's nothing that says you can't give out that information (although its generally bad for business), unless that's part of the rental/condominium contract.
I don't deal criminal law much, I bet MarkT can give you better details. |

129. Every one who
(a) resists or wilfully obstructs a public officer or peace officer in the execution of his duty or any person lawfully acting in aid of such an officer,
Police Services Act (Ontario)
42. (1) The duties of a police officer include,
(g) performing the lawful duties that the chief of police assigns
so since "duty" isn't really defined, I'd have to look at the case law, and QuickLaw isn't cheap, so ...... |

You are not required to devulge any info about anyone you don't want to. Period. |

You could ask to see his badge and if that's not enough you can call to verify that he is indeed an officer. (that's what I was told but I'm not sure what number you would call)
Event after all that, no warrant = no info. |

Ask to see his badge and right down his badge number and name.
But just like everyone said, he has no right to arrest you if you don't give out information and he has no warrant. |

No need to be super rude. I forget what the actual name for the charge is, but you can get charged for being an to a cop as well. |
