funny thing though snooty fox, king paisley and the tap house are right in the heart of westadle and generate just as much disturbers as quarters yet they dont point the finger at those pubs.

thats also something that should be fixed... if someone drowns in his pool he shouldnt be liable.

As for the pub, that is moot. Its a university area and kids are drunk whether its a pub or on their own. As i said if you dont want to deal with students then dont live near them. Hamilton is a big town and canada is a big country.

i wonder what the real agenda is then?

or perhaps they will go after them next until everything is closed?

either way this guy should just cut his losses and move somewhere where he may enjoy life more.

Criminal Harassment .... its a long shot at best.

264. (1) No person shall, without lawful authority and knowing that another person is harassed or recklessly as to whether the other person is harassed, engage in conduct referred to in subsection (2) that causes that other person reasonably, in all the circumstances, to fear for their safety or the safety of anyone known to them.

Prohibited conduct
(2) The conduct mentioned in subsection (1) consists of

(a) repeatedly following from place to place the other person or anyone known to them;

(b) repeatedly communicating with, either directly or indirectly, the other person or anyone known to them;

(c) besetting or watching the dwelling-house, or place where the other person, or anyone known to them, resides, works, carries on business or happens to be; or

(d) engaging in threatening conduct directed at the other person or any member of their family.

Punishment
(3) Every person who contravenes this section is guilty of

(a) an indictable offence and is liable to imprisonment for a term not exceeding ten years; or

(b) an offence punishable on summary conviction.

Factors to be considered
(4) Where a person is convicted of an offence under this section, the court imposing the sentence on the person shall consider as an aggravating factor that, at the time the offence was committed, the person contravened

(a) the terms or conditions of an order made pursuant to section 161 or a recognizance entered into pursuant to section 810, 810.1 or 810.2; or

(b) the terms or conditions of any other order or recognizance made or entered into under the common law or a provision of this or any other Act of Parliament or of a province that is similar in effect to an order or recognizance referred to in paragraph (a).

Reasons
(5) Where the court is satisfied of the existence of an aggravating factor referred to in subsection (4), but decides not to give effect to it for sentencing purposes, the court shall give reasons for its decision.

I've lived in Westdale going on 5 years now. Someone in this section of Hamilton is always pissed off about something, and they always find a way to trace it back to the university (mostly because we will listen to them whereas the Hamilton Spectator laughs at them) which I find funny, as the university was here BEFORE THEY MOVED HERE.

And I won't even mention the assortment of pubs strewn throughout the remainder of Westdale. They would never be able to trace it back to the school's pub.

Before Quarters was the Downstairs John and Rathskeller (still semi-operational), which attracted the same types of crowds so the hate for Quarters seems left-field (read: vengeful) anyways.

P.S. The Docks is still open.

these three right here would be covered under the law if this new story is accurate and if i were a judge i would be sympathetic to the people in the video.

the docks is under temporary order. The case isnt over and could still be shut down.

I think everyone should make their feelings known to this person. Do it in a calm professional manner and make some good points. In short, be civil.

how about putting some responsibility on the students to act like the adults that they are?

we all know that the police response is a joke unless you say a gun is involved...so they'll never show up in time to actually catch any of the students in the act of doing something wrong.

I sympathize with residents experiencing property damage, trespassing and unreasonable noise at 3am.

what they are doing is ridiculous though.

then a cop would be able to testify after they have been called to break up the ruckus. It would be a different case altogether. But i wouldnt allow the videos as evidence in that case if its harrassment. Especially if the people in the video are openly objecting on film to their images being captured.

If police response is a joke, then change that. But dont break the law or harass people in the meanwhile.

and if it sucks that badly i still say "just move". Its a big country.

mark, imagine for example if some old guy moved into the village and started complaining about gay people holding hands. It's the exact same idea.
