ok so craig, if mrs. hazard was driving along, completely sober, and you happened to call her on her cell phone, and she looks down for a minute to look for her cell phone while she's pulling out onto a street (she gave a quick glance and thought the coast was clear), and gets creamed by someone who was doing maybe 10 mph over the speed limit, and was drunk, and mrs. hazard (god forbid) dies in the accident, would you honestly sit there and think it was her fault just because she pulled out in front of the drunk?

i'm just using her as an example so you wont view the situation like you would from your work, where the people mean nothing to you.

i think the accident would never have happened, had the drunk driver not been on the road in the first place, which is the LAW (to not be driving drunk), so therefore, it's the drunk's fault, no matter what.

i'm pretty sure that's the law in florida too.

So if someone is driving drunk and gets in an accident, but it was the other person’s fault (like they pulled out in front of the drunk person), whose fault do you think it is? Especially if the person who caused the accident dies...

Regardless of who's at fault, the drunk driver will get most likely a DUI, and additional charges pending.
