If you got hit from behind, that would be her fault... but if you hit the guy in front of you from behind, isn't that your fault for having stopped too close?

Moral? Someone?

Moral Hazard
Fault in an instance such as this is a tricky thing. First and foremost; were you stopped or in motion when the party behind you struck you? If you were at a complete stop then it is likely you will be found to have no negligence in the matter. If you were in motion when struck by the lady behind you then you will be deemed at least partially at fault for the damage/injury of the party you were pushed into. See, negligence is what determines fault (in a Tort environment)... negligence is failure to do what a reasonable person would do or doing that which a reasonable person would not. Judges have pretty much ruled consistantly that a reasonable person would leave sufficient space between their vehicle and the vehicle in front of them that they are able to safely bring the vehicle to a stop and avoid collision regardless of the severity of breaking or impact from the rear. So, if you were in motion then you will be partially negligent thus partially liable for the damages to the person you rearended. How much liability you will bear depends on a number of factors... you've provided insufficient details for me to provide a more accurate liability assessment. If you have questions or concerns PM me... this is what I do.

this "neck and back pain" won't affect you unless their bills go over your policy limits; either way they'd have to sue your insurance company. they can't just arbitrarily sue you.

Why am I not surprised moral hazard is the expert on being non-consensually shunted from behind? i tell ya, these catholics!
