isn't that what the religious types are fighting against?

Mainly, church leaders are worried that once gay-marriage is legal, maybe not right away, but eventually, they will be charged for some type of crime for refusing to perform the marriage ceremony or provide their property for the ceremony. It's already happened that homosexual couples have requested to use church-property for ceremonies and legally challenged said church for refusing. I don't know the exact details, I just heard on the radio that it has happened.

Now, the militant religious protestors are a bit of a different story. Religious types are fighting against ANY making-legal of any act that is forbidden or immoral, according to their teachings. Before gay-marriage, it was divorce. But that's a lost-cause crusade now that it's legal and accepted in society, so now it's gay-marriage. After gay-marriage is legalized, the fight will turn to poligamy, as is just starting to warm-up here in Canada, moreso in BC.

The problem is that all these things that become legal/illegal are personal decisions that no law can stop. Laws can ONLY PUNISH these acts after they have been committed. If I wanted to murder someone, and I had a gun, realistically there is NOTHING that ANYBODY can do to stop me murdering that person. The ONLY effective means of getting someone to stop committing an immoral act is to convince them to accept that the act is, in fact, immoral, and let them make the decision to stop.

You CAN'T legislate morality. The religious militants need to stop wasting their time and money lobbying government, and start investing that money, time and effort into community projects where they go and PERSONALLY talk to people on the streets about the issues they care so deeply about.

im kinda confused. if government cannot tell you who you can marry, and church cannot tell you who you can marry then who can???

The government can tell you who you can marry, this is taken directly from our amended Constitution (which was recently amended to add section 7.5 by a simple majority, or over 50% of the popular vote):

CALIFORNIA CONSTITUTION
ARTICLE 1 DECLARATION OF RIGHTS

SEC. 7.5. Only marriage between a man and a woman is valid or
recognized in California.
Dr. DAS
If Californians are so dedicated to preserving the sancitity of marriage, why don't they ban divorce instead?

...oh, right.

as much as i disagree with the outcome in california, at least it was done democratically. In california the public voted. In Canada it was imposed upon us by unelected court judges. At least we validated it somewhat witha vote in parliament thanks to harper, but there is nothing more democratic than a public plebicite whether you agree with it's outcome or not.
