The girl has now been charged with Tori's murder too, I bet this is because she couldn't help them locate the body...

If they're lawyers are smart they would be telling them to shut up. I could see them getting off now if no body is found. She may have signed a confession though originally, but he could definitely get off...
Hope they find the body and get convictions! |

Hmmmmm... what an interesting turn of events... He's the one keeping quiet.... and she opens her mouth and gets her charge upgraded.... could it be her upgrade may become a downgrade for him in the near future? |

I couldn't find any information on this via Google, but I know it's the case in many American states - is the body really required? If there are charges laid, it's because the CA believes that it can prove those charges beyond a reasonable doubt.

I think they laid the original charges because of her confession. That alone may get her convicted, but without any other evidence he may get off. Although he may have buckled under the pressure and confessed too? They definitely want the back seat of his car though!!!
She may even be able to say she made the whole thing up for attention and possible get off? Until we know what either of them said it's a total unknown.
I hate not knowing something!!!!!!!!
EDIT: yeah, I'm not 100% but I don't think you need a body in Ontario. Did Bernardo get convicted for killing a Jane Doe because they had the video but no body? |

| What bugs me is that they could get life in prison. Any prison time for people who do such things is a waste of MY tax money... |

I honestly would rather see people like that suffer for life than have a quick and easy end. Killing them would be an easy way out for them, I want people like to suffer and to think about what they've done.
Although, at least in Gen Pop the end to there life would be painful.... |

As a police officer, I can tell you that a body is NOT required to lay a murder charge; however, since your entire case becomes circumstantial, the crown attorney will need a considerable amount of evidence to prove that she is dead - hence the search for the backseat.
I can pretty much guarantee that there was a deal in place for McClintic - give us the body AND testify against him and we won't upgrade the charges. Since she couldn't provide squat, she gets the murder charge now. At this point, they don't have ANY clue where the body is.
Could either of them walk? Highly unlikely. In all likelihood, there is fibre/hair evidence in the car that indicates that Tori was in it, and there is some evidence (not released to media) that Rafferty was driving when Tori was taken. Obviously, McClintic isn't going to walk considering she was caught on camera with Tori. Expect her to plead out.
Although a kidnapping conviction is pretty much a slam dunk, the Crown has a lot of work to do in order to get a murder conviction and at this point, I'm not so certain that there's enough evidence yet. There's a lot of reasonable doubt out there. Either defendent can point the finger at each other, or a third party. Let's not forget Tara MacDonald either. Consider that she has orchestrated a media circus around her daughter's disappearance and has repeatedly changed her story to fit whatever details are introduced, she has created her own motive - attention seaker. She hasn't done anything yet to rule her out as a suspect. |

i want to know what happened dammit!
i am sure the mother/father feel 1 million times more frustrated. i would need to know what happened.
this has been the most mysterious murder case in a while, usually police can't wait to blab their mouths off. |

I would assume all that evidence was in the back seat and they can't find that now....
As horrible as it is, I hope they find the body so they can nail both of them! |
