No, it's not a true story, but similar things have happened. The company I work for got sued because a woman walked into a glass door we had installed 6 months earlier. Apparently it was too clean and she didn't see it. She won.

There is currently a lawsuit in place: some inmates at a prison have sued because they were forced to listen to Christmas music; they say its 'cruel and unusual' punishment.

Prisoners do that because they have nothing better to do. They're going to be in jail for life, why not use the state's money and lawyers to sue the state. I heard about someone who was in jail for life without parole for raping and murdering several women and he sued the prison for serving him cold soup and won a million dollars.

If you go to the doctor now they will give you all sorts of pointless tests that you don't need to prevent you from suing them later saying that they didn't catch something. This drives up medical costs and wastes your time.

Factories are afraid to upgrade to more environmentally friendly practices because of the amount of sheer paperwork that the EPA will require them to fill out.

These examples could go on and on. The legal system has gone completely insane. I wouldn't be surprised if it is the downfall of Western civilization.

Yes, you are correct. I don't want an 'education' from you. If I wanted that I would go to someone who actually has something to teach me, not a person who thinks they do. In using the term 'faux-intelligent', I was referring to your claims in the car thread that I used ad hominem and strawman arguments, when I actually did nothing of the sort. I tend not to respect people who use words without understanding their meaning.

Of course not, there is always room for improvement, but regardless of what system is in place there will always be exploitation, mis-use and waste. The best we can do is try and fix things as we go along.

I think the system needs work but I'm not gonna pretend that people in China are better off than I am. They aren't. I'm glad I love in a country with the protections and laws we have.

It's more so corporate 'arse-covering', as we call it in my industry, that is the problem. The director of our company has been a builder for 25 years and has never had a claim or misdemeanour levelled against him. I know it can be a hindrance in many cases, but like I said, it is there for a reason (most of the time, in your case it seems overzealous).

You can do it this way or go to China where they put weird chemicals in milk and there is no free speech, the only accounting agency is the government, and they can pretty much do as they please.

but consumer safety, free speech, and rule of law are the enemies of success--the sole measure of which is economic growth. do you want to live comfortably or do you want to win? that is the only choice here!

my post was about america because i'm american and that's the western society i know best. america is also a perfect example of economic dominance in decline and frivolous lawsuits. i don't try to characterize things i don't have a clue about, like you did with american cars and the corvette. you seem to be quite skilled at arguing sweeping generalizations. first with cars, now with societies. i'm not foolish enough to clump together half of the free world and start making generalizations as if we're all under the same legal system. apparently you don't see how you could possibly go wrong doing so. all you need a premise and some anecdotal evidence to piece together an argument and bat down anyone who dares to question it. great, keep up with that, but you aren't convincing and i'll still point out when you're full of .

since you're having trouble identifying your false dichotomy, here it is again: the choice isn't between economic power and legal protection. being second in gdp to china isn't even a real dilemma. if there is a decline in our way of living, it's because it's unsustainable, not because china has a better model. yes, without legal protections and a command economy it's easier for a nation like china to grow faster than the rest. especially if they are supporting the unsustainable habits of the largest economy in the world for several decades. hell you have to be kidding yourself if you think china's growth is sustainable. they're amassing a ton of wealth right now (devaluing their currency helps a lot), but they have a world of problems right on their heels. the fact that it's not a free society means you aren't even hearing about these problems.
