Have you fought your speeding ticket? Got My first ticket today..

So my aunt is currently on life support due to surgeries that are being done because of her cancer. Earlier today, or better yet, yesterday I was debating wether I should go to work or call in and spend the day at the hospital. I decided I would go to work but I left 10 minutes later than I usually do, so there I went and sped off. Unlucky for me, there was a CHP hiding right after the curve. He pulled me over and cited me for going 84 in a 55 mph zone. He asked if I knew how fast I was going but I stood quiet, he then yelled and asked again and I replied "fast". , I couldve just replied with a simple "no" but I was too damn nervous and really stressed out, I wasnt thinking straight. I technically didnt admit guilt, did I? Im going to plea not guilty, I really hope I can still fight it. I heard I can be looking at $400+ fine + a really high insurance spike because I am only 20. Any tips or ideas that can help me out that used if you have fought your ticket? Oh I may have something that could help me, the cop noted on the citation that it happened on Sunday when it really was Monday. Im not sure if that could do much good for me. .
I work evenings which denies me time of having a life, I had plans to quit my job over the summer and spend time with family & friends, beach, audiotistic, vegas, and go back to school next semester but with the heavy fine and the insurance hike I may have to keep my job :mad: . I know its only a traffic stop but its my first and Im ting bricks. |

| I've never fought mine, but most of the cop friends I have say fighting speeding tickets are nearly impossible. I can tell you that fine is accurate if you decide not to pay it outright and do traffic school. I got one last December for 62 in a 45 and it ran me about $430 with school and the fee I think. Insurance didn't significantly increase however. |

First ask for a court appearance on www.lasuperiorcourt.org (if it was in LA County)
When you go to court, tell the judge you want to plead not guilty and request (O R) which basically means you don't want to pay for it now and you will pay if and when you lost. Many times the judge won't grant O R which means you have to pay and they will give you a Trial date.
On the date of Trial you pray the cop doesn't show. If he doesn't show up, you win. If he does show up, then ask him if he will amend the ticket to 65 or something lower than 15 miles over the speed limit. It will bring the fine lower, also ask the judge for traffic school (if cop shows up), if you take the traffic school, you won't get the point on your record and your insurance rates will not go up. 2nd time traffic school (12 hour), you won't get the DMV point, however insurance will still go up. |

In the bay area, the police don't have time to pursue missing persons but they have time to sit and give tax paying citizens speeding tickets. I lost a lot of respect for police when I got a ticket earlier this year for failure to stop at a stop sign. I rolled through at literally 1 mph and the officer gave me a ticket. First ticket I've had in over 10 years.
The insurance aspect of it is a total racket. Yeah 84 in a 55 is pretty fast, but I think your first offense shouldn't affect insurance. Then again I'm living in my own little dream world.
I think it's good advice to go to driving school and speak with the officer. Best of luck. |

You broke the law and were caught.
From the cops I have met, they hate having to go into court when someone decides to fight a speeding ticket rather than just admitting they are guilty. I'm sure there are a small fraction of tickets where the cop got it wrong, but not the vast majority of tickets.
The OP admits he was going fast (and he doesn't debate he was going 80+ mph), yet he is willing to tie up valuable court resources instead of just dealing with the consequences. Officers would rather be out dealing with real crimes than going into court.

84 is waaaaay over the speed limit and potentially very dangerous if he was driving much faster than everyone else. You don't have to like the speed limit, but it is the law.
Why shouldn't your first offense affect insurance rates? He has shown the insurance company that he is willing to drive more recklessly than the average person. In light of this new information, he is a greater risk of getting into a accident. I'm sure this wasn't the first time he drove 80+ mph. |

Unfortunate to hear your circumstances chavag... but come on schuey that is some pretty spirited driving.
Either way, I used Mr. Ticket down here in SD, he lost my case and charged me $100 to do so. I was going about 70 on the freeway... same as the rest of the cars and just happened to get singled out. It's the only ticket I've ever gotten, so I was pretty pissed. Anyways, it seemed like Ticket asked for a trial date and might have gotten the date extended a couple times to try to bury it in paperwork a little bit. He ended up pleading guilty on my behalf for whatever reason (so him too). It did however extend my payment time for a while. I paid around 8 or 10 months from the date of the ticket if I remember. The traffic school was around $40ish range (because I had to do rush shipment) and a lot of the questions were about speed racer. Took about an hour thanks to pasting the sections into Word and then using Ctrl+F

Only other recommendation is that you do the traffic school right away so you don't have to pay for the rush shipping. |

You WILL WIN if the cop doesn't show. But the Judge may increase the fine and not grant traffic school if you try to fight the ticket when the cop does actually show. Best call is to change your plea to no contest or guilty and request traffic school when you see the cop showed up. |
