okay peoples help me out here.... i got a $100 parking fine today for parking in what i thought was a 1 hour zone, but instead turned out to be a ing clearway... the thing is, when i parked the car i didnt see any signs and there were no markings on the road to indicate a clearway - it was only afterwards that i saw the sign which was bent away so i couldnt see it from where i'd parked the car.
Obviously i want to challenge it - firstly i dont think i should have got the fine in the first place and secondly, i dont have the luxury of being able to spend $100 on a ing parking fine.
Has anybody successfully challenged a parking fine before??
whats the best way to go about it??

Say that you would like to have the matter heared in court. Then see if they can be bothered to take you to court over it. A lot of the time they can't. Or say you have school/exam or something on the day of the trial, they won't reschedule.
Alternatively, you can just not pay the fine and have your license cancelled.
The lesson to be learned here is that you should always leave a parking ticket under your windscreen wiper at all times |

I'd argue that you couldnt see the sign at all and therefore you shouldnt pay. But in a more intelligent way, possibly trying to cite cases. Im sure there have been some civil trials where contract law has been debated due to not being able to see the conditions of the contract clearly.
(I did commercial law for a semester at uni, by "im sure" i mean, nearly 100% sure, but, whether that case would help you im not sure) |

same thing happened to me
I was parked in what I thought was valid parking as it had meters on the side of the road but was a loading zone
I argued the fact that I was decieved as I saw parking meters but they basically told me to get fuct and slapped on an extra $60 bux cause I didnt send the form in on time

a tip when getting a fine:
give it to the next car - many ppl don't read it properly and will pay it for you. if not then you will get the fine re-issued anyway. |

Yeah, parking fines suck. :-/
I went into the city with a mate a couple of weeks ago to buy some shirts for this ball we were going to (just to make sure we looked cool - you know how it is :rolleyes: ) and we parked in La Trobe St, right near the State library (for the Melb peeps who know where I'm talking about) and parked in a meter zone. The sign said "meter zone 8am - 4pm" or something, and given that it was already 3.47pm we thought it, we'll pay the 70c for the 13 minutes parking just to make sure.
So we come back at about 5 and that's when we noticed the rest of the sign - "Tow Away Zone 4pm - 7pm". Needless to say the car wasn't there. :rolleyes:
So we had to go to the car impound place on Swanston St and my friend got stung with a $170 tow away fine. Then, just to take the piss, when they took us to his car he found out that he had a $100 parking fine on the windshield as well. $270 for about 75 minutes of parking. Bloody bastards.

one time i went into the city with a bunch of mates .. parked the car in a no standing zone (it was out of the way, no idea why it was no standing, wasn't across a driveway or anything). get out of the car and notice the other people who'd already parked in the same zone had been booked.
*yoink* the fine off their windscreen, put it on our car, bingo :D

More advice on parking in the city:
If there's nobody around to steal a parking ticket from, park in a loading zone, put your bonnet up and turn the hazard lights on.
Maybe even leave a note on the windscreen that says "my car has broken down please don't book me - i'm going to get help"
Who is gunna book you? Who is gunna try and steal the car?
