No one is debating whether it is illegal or not, that's pretty clear. The question on some peoples' minds is whether it should be.

If the position of power abuse factoring into the act, then yes. I'd hazard a guess in this case the kid was into it regardless of she was a teacher or not, so I'd hate to see her punished for something they both wanted. How to draw legal lines for that though would be pretty messy. |
