NYC nightlife 1am Shut down?

OK once again we are being shafted by the city govt...Check this Email Alert I received:
Dear Friends of Luna Lounge,
I am sorry to contact you in regard to something other than a calendar
update, but this new NYC government proposal will very seriously effect the
ability of Luna Lounge and other live music venues to stay open for your
entertainment. I believe this appeared on page six of the New York Post:
January 30, 2004 -- BAR and nightclub owners are in an uproar over a
proposal that would require a "nightlife license" to stay openafter 1 a.m.
City Consumer Affairs Commissioner Gretchen Dykstra is pushing a plan that
would require a special two-year license for any nightspot with acapacityof
75 or more where the music would be 90 decibels or higher. A place would
be padlocked for up to 10 days after three noise or other license
violations, and would have its license revoked if it was "indicted"
for any two of the following: homicide, assault, rape orattempted
rape,weapons possession, unlicensed sale of liquor, sale of liquor
tominors, overcapacity, disabled sprinkler systems or two Consumer Affairs
padlocks. Nightspots would also be slapped with violations for failing
tosweep the sidewalk and 18 inches of adjacent street by 6 a.m. the next
morning. David Rabin, president of the New York Nightlife Assn. and
co-owner of Lotus, says Dykstra's plan would let the city effectively shut
bars and nightclubs down at 1 a.m. "This bill will end up closing New York
at 1 a.m.," Rabin warned. "It's no longer going to be the city that never
sleeps. We're united on this - everyone from the little bars to the biggest
nightclubs. The best-run bar in the entire universe could not stay open
under the conditions in this proposal."

WTF? THIS IS A TOTAL JOKE!...how can they possibly shut nyc after 1 am? wtf:whip: ok, i understand the smoking rule...but 1 am...ffs even in jersey, they close down after 3 am!

It's an attempt to reform the current laws where establishments (clubs, bars, lounges, restaurants, etc) need to have a cabaret license in order to be allowed to allow the mere act of dancing (by I believe 3 or more people) on the premises. (have I confused you enough? :) )
I was at the town hall meeting where these laws were discussed, and people were allowed to give their input, and this is the proposal that has resulted. There were swing dancers there who complained about not being able to do their thing because of the current laws!
Dykstra (and other members of the DCA) agreed that dancing itself is not the issue, and are trying to remove the term "dancing" from the laws, but there are the greater issues of ensuring that venues are safe environments for dancing (and in general, for just having such large gatherings of people), and do not cause too much of a disturbance to neighboring residents or businesses (in terms of the sound, and the cleaniness of the streets).
Most of the audience who spoke, did so in favor of the nightlife industry/community - I got the feeling that most did give valid points about why it's important to allow dancing and keep these places open and change these laws, but unfortunately did not (or were not able to) offer enough in the way of possible solutions to address the issues above. I hope that those who wrote in were able to do better. btw, I'm just curious - did anyone here submit any comments to the DCA in writing?
Also, at the time of the meeting, there were rumors of the city considering making places close (or stop serving alcohol) at 2 am, and Dykstra said that those were not true.
I think everyone agreed that the laws need to be rewritten, but exactly how they should be rewritten is the difficult part. You have to look at things in the perspectives of all the people involved, and figure out what kind of compromise will satisfy everyone.

| If they do this than NYC will no longer be a tourist attraction, if they were smart they wouldnt do this. This will cause major decrease in NY's economy. There really are alot of idiots in politics. |

way to take the new york out of new york!
people come here to get that 24/7 feel, lets just shut the nightlife down at 1am so does that mean they turn off the lights in times sq at 1am too? heh kinda funny how they try to target social scene's yet still want the dingy NYC nightlife image to remain. stop trying to with our nightlife! |

if people shut down the clubs at 1 then there will be alot of underground raves and parties all over and then the city would have to go after them, no matter what the parties wont die in nyc this is a music and party town
