EU prepares to battle Microsoft



BRUSSELS—Regulators are set to argue that the European Union needs to take a tougher stand against Microsoft Corp. because its antitrust rules are different from those that allowed the company to avoid making fundamental changes to its business model in the United States.

In a 63-page confidential pre-hearing filing seen by Dow Jones Newswires, the EU Commission says "U.S. antitrust law is different from EC competition law" and that "the concept of abuse of a dominant position does not exist in U.S. law." Findings in a U.S. antitrust case against Microsoft "cannot simply be transposed" to Europe, the EU says.

EU and Microsoft lawyers will square off next Thursday at the Court of First Instance in Luxembourg, Europe's second highest tribunal.

The software giant is appealing a ruling made by regulators in March fining the company a record 497 million euros ($733 million Canadian) and requiring it to hand over software code as well as restrict the way it bundles Media Player software with Windows. After the hearing, court president Bo Vesterdorf must decide whether to freeze the EU's punishment pending a final decision.

Transatlantic divergence over Microsoft's "bundling" practices could be a critical point in the case. Microsoft accuses the EU Commission of crossing a doctrinal red line by ordering it to remove software that plays music and video clips from versions of Windows. In contrast, the U.S. courts approved a milder remedy that refrains from intruding in the design and engineering of the Windows operating system.

Those who don't appreciate this ruling... You have to realize that this is for the greater good.

By bundling Windows Player into windows, Microsoft is essentially killing it's competition. How many of you are still using Winamp for listening to music/watching movies?? Probably not too many. Even though it's arguably a better program.

Monopolism kills competition. And competition is necessary for further progress.

In particular consider this: Internet Explorer at one point killed Netscape. And... for 3 years we have seen absolutely no progress in browsing experience. Only now, 3 years later, Mozilla finally introduced some new features, and Explorer will follow it's footsteps.
