Just be thankful that this accident didn't happen in DC. Aparently, DC law doesn't require that u exchange insurance info at scene of an accident. People there have gotten so brazen now, that hit & run has become a major problem there now (esp. if they hit a pedestrian).

Even if u call a cop over, their attitude is "i didn't see it, so tough". DC cops don't like to do any work at all, unless it involves issuing a ticket for any infraction, which means $ for the gov't. THEY ARE THE WORST & LAZIEST COPS ON EARTH!!!

I know exactly what you mean about it being YOUR car. I kill people when they lean on my baby. The paint and finish on my car is better than 99% of new cars straight off the showroom floor these days. I pride myself in that fact. She may be boxy, but my it is comfy (who doesn't love porno-red velour interiors) and chrome EVERYWHERE.

NO FAULT INSURANCE EXPLAINED:

In June 1990, the Ontario government and the industry introduced the concept of "no-fault" insurance.

To many people this suggested that they would no longer pay higher premium if they had an accident. Not so! In fact, under the "no fault" legislation, fault is allocated based on accident scenarios described in the Fault Determination Rules contained in the Ontario Insurance Act Regulation 668. In other words, fault is allocated to each driver based on which accident scenario most closely resembles the accident. According to the legislation, a driver can be 100%, 75%, 50% 25% or 0% at fault. Any driver who is more than 0% at fault will have an "at fault" accident on his or her record and will likely pay a higher insurance premium.

The Insurance Act and the Highway Traffic Act are different legislation, so you may be 100% "at fault" in an accident under the Insurance Act and not get a ticket under the Highway Traffic Act.

"No fault" insurance means you deal with your own insurance company regardless of "fault" for both repairs to your car and for accident benefits. Therefore, choose your insurer wisely because you will have to deal with them if you are injured!

6.(1) This section applies when automobile "A" is struck from the rear by automobile "B", and both automobiles are travelling in the same direction and in the same lane.

(2) If automobile "A" is stopped or is in forward motion, the driver of automobile "A" is not at fault and the driver of automobile "B" is 100 per cent at fault for the incident

(3) If automobile "A" is turning, either to the right or to the left, in order to enter a side road, private road or driveway, the driver of automobile "A" is not at fault and the driver of automobile "B" is 100 per cent at fault for the incident.

it's a crime that something close to the RS isn't available here. SVTs are nice, although for the original price, I'd have bought a regular one and turbo'd it ;) When Ford dealers were getting rid of the last ones, you could grab one for more than 5k less than before, brand new. I had a lightly modded ZTS for a couple of years that was pretty fun to drive :)

glad to hear you're ok RJ...hopefully that f**k especially goes down for having expired insurance. I know if you're pulled over and have none, it can be a 5k fine...yes, *5k*.

Your rates should not go up over one not-at-fault claim...but if the damage is reasonably minimal, it's almost worth your while to just fix it yourself...cause 1 (or 2?) more...even not-at-fault claims...and your rates will go up upon renewal.

I really feel your pain. Anything that we can do to help we will.

The first thing is to report it like you already are (you don't have to go first thing in the morning, the car is still drivable right?) you have a few days to report it. the worst part is that the guy doesn't have insurance so you are pretty much stuck with the bill unless he pays out of his own pocket. make sure you harass him about it over and over again. tell him that it will be much worse for him if he doesn't pay (which it will be).

btw, when i got hit, i wasn't expecting the cost to be so high. 750 dollars for a quarter panel but where you get into the cost is the paint job that has to be done.

Em Is right. Your personal well being is more than important than your vehicle. But I am glad u did not get hurt.
