Sorry to hear about your car man, I hope that tool gets what's coming to him. ;)

They wouldn't come to the scene of the accident? That's f**ked.

Last summer my sister backed into our neighbours Tiburon, which was parked on the street. Stupid thing to do still, but she was honest and told them what happened within seconds. And yet, even though we live ACROSS THE STREET, they called the ever-so-wonderful Durham Regional Police. It seems these guys ARE willing to come out to accidents where no one is hurt, and they talked the pig into giving my sister a "Failed to Yield to Oncoming Traffic" ticket. WTF is that? We fought the ticket and one, but I'll never fogive them.

From now on, when one of them parks in front of my driveway, and they're watching, I back out really fast, just to make them squirm.

I feel for you RJ. I'm glad you're alright. I know you're not at fault, but I've never met an insurance company that didn't screw you.....

The extra sad thing is that with no insurance, you couldn't get anything out of the guy for injuries aside from chump change that he personally could afford.

Holy ! Rj, glad you're relatively ok. Get the neck checked out ASAP if you haven't already. As for the ****** who rearended you.:mad: Get him to pay for some of it at least, . Insurance will be a huge pain in the ass anyway but at least there is some semblance of being protected that way? I dunno. Hopefully that works out for the best...

I think your car will be fine - I am crossing my fingers for you and since it wasn't a Brutal accident (rear ending only) you should have an alright turn out - I hope you got all his mutha fu*ckin details b/c his ass is yours!<---to kick!

I don't think you should claim it on your insurance. They always find a way to screw you even though it's not your fault. Your best bet is to settle it with the bastard that hit you. Also, report him for not having insurance.

Man, so sorry to hear this RJ.

#1 though.. with no-fault insurance in this province, you always pay, so his not having insurance has no effect on you and your rates, other than him perhaps paying for a rental car and physical damages to you. The 2 main reasons you're rates go up are claims (no matter the fault) and having an @ fault on your record. Tickets are a close 3rd of course.

Unfortunately, your only hope is that he throws up some cash to cover the damages, otherwise you report it and take a nice big rape from the insurance company on your future rates. If the damage isn't that far off the deductible, then I say just get it repaired and keep it on the DL.. don't want an accident on the car history.. really decreases the value on resale.

The system in Ontario is terrible.

I've been driving sans insurance for 3 yrs, simply because I was cut off on the DVP by an racing during rushhour. When he cut infront, he stopped.. with my 10 ton company truck rolling right over him. Because I was the rear driver, I was found @ fault and insurance for me on a 96 Sunfire costs 6 grand a yr. I would take care of my responsibilities if I hit someone, and probably still come out ok financially compared to if I spent $18,000 on insurance these past 3 yrs, then payed $1000 deductable on an accident + an increase in rates.

I'm not sure about Ontario, but that's a $10,000 fine at least 2 other provinces that I know of. Not only that, do you have any idea how easy it is to run $5000 worth of body work? A repaint of a fender and new bumper could equal $5000. If you drive a 96, that's more than the value of your car. What about if you (God forbid) kill someone? Will you take care of your responsibilities to the family? Could you pay them 5 or 6 figure compensation at the drop of a dime?

Well, it's a $5000 fine here, so essentially less than the cost of 1yr of insurance for me. If I had cosmetic damage, oh well, no biggie, happens. Anything major and I'd scrap the car for parts. It's a 96, although in mint shape with only 90,000km on it, but it's value hovers around $4-6grand, so not worth a major overhaul.

And of course I'd take care of anything that was my responsibility. As for 6 figure compensation, this isn't the lawsuit-happy USofA, and their own car/life insurance would provide the majority of any compensation, as opposed to the other driver. There is also an uninsured drivers fund that covers those kind of situations. Nice dramatic touch though.

I've payed insurance in the past, and once it is affordable for me, I'd happily pay into a fair program. Right now, I refuse to pay $6000 for having one seatbelt ticket, and 1 accident that was arbitrarily listed as my fault by a lazy-ass OPP officer using an idiotic system on my record.
