Club faces $6,000 in fines over noise
Island dwellers buoyed by decision
A Toronto appeal court has upheld a conviction against the Docks Entertainment Complex for violating noise bylaws.
The nightclub, which sits on the waterfront at the foot of Cherry St., must pay $6,000 in fines and is prohibited from excessive noise at one part of its complex.
"It's very good news that the conviction has been upheld because the noise has been quite phenomenal that comes from there," said Freya Godard, who has lived on Ward's Island for 35 years.
The conviction, stemming from music events in the summer of 2001, adds fuel to the longstanding feud between the nightclub and residents of the Toronto islands.
Islanders have asked the Alcohol and Gaming Commission of Ontario to revoke the venue's liquor licence, citing countless sleepless nights for members of the 250 households that lie within 750 metres of the complex.
Although the noise charges ruled on by the appeal court are independent from those ongoing hearings, Godard hopes the conviction will influence the commission's decision.
In July and August 2001, two live music events — the heavy-metal OzzFest and Area: One, an assembly of electronica, rock and hip hop — were held in the club's parking lot.
Nicholas Macos, the lawyer representing the nightclub, calls the charges "guilt by association."
"The Docks didn't have its hand on the volume knob.
"It didn't hire the people. It didn't set up the sound. All it did was provide food and beverages and allow its name to be used in association with advertising," he said.
What's more, Macos added, the Docks has not held any music events on that parking lot since.
Throughout the alcohol commission hearing, Macos has maintained the liquor licence is a matter of survival for the Docks, which employs 300 people and draws half a million visitors a year. |

I think they should revoke the island residents' permits instead.
Im sick of that merry band of whiners setting the policies in this city and they dont even pay freaking rent, taxes or mortgages.
F THEM! Time to relocate these idiots somewhere in Nunavut so they can get their desired peace and quiet.

No kidding. This is all too common in Toronto, bull noise complaints from people who have nothing better to do but sleep. If they don't want noise they should move to Wasaga or something.:tongue3 |

Dont tell me those people cant sleep. All it takes is closing the window. The problem with these idiots is they dont have a leg to stand on. They have a sweatheart 99 year lease for $1 and still have the nerve to complain about everything. They didnt want a fixed link bridge, the stopped expansion of the island airport, and now they wont allow life on the mainland to continue as it should. I cant wait until real development happens in the portlands so that the rest of the city can feel the wrath of the whiney island squatters. Noise travels across water so just wait until these whiners start complaining about every day traffic noise when population comes to the portlands. I think the feds, the province and the city should get together and buy out the islander's leases so that the rest of the city can sleep a little easier. |

The news clip mentions..."...no excessive noise from a certain area of the complex.." I wonder of they mean the parking lot where the noise originated from in the first place during Area:One ..Otherwise the Docks can still pump out the tunes INSIDE the club at the usual volume...Maybe Tekhead can give us more insight here:confused:

I will post in defense of the island residents. It's not just a matter of closing their windows as they point out everytime they are interviewed. The bass sound from The Docks carries over the water and shakes their homes. And this isn't just once in a while. This can be almost every night of the week during the summer. Everyone that's been over there and heard what they are talking about agree that it's ridiculously loud, myself included.
I'm sure some can relate to being on a lake in cottage country with that one cottage having a party at night. It sounds like it's next door. Hell on a quiet lake you can hear people talking across the water if the conditions are right. Sound carries over water and is lot louder than anybody at the source of the sound thinks.
People's houses are their sanctuaries and everyone deserves peace and quiet at night. And I'd argue that the islanders by the nature of their community (and it's history) have the right to complain about the EXCESSIVE noise coming from the Docks. By the same token I'm sure many people here would not appreciate being interupted EVERY night when they are trying to sleep. |

Who the moves to an island in the bay of Toronto for quiet?!
What about all the ships during the day? Are the shipping companies gonna get fines for their engines being to loud?! Or planes taking off and landing?! Dont tell me you cant hear those! |

I agree that sound carries over water. This is exactly why I say that you shouldn't expect to live across the water from such a huge city and expect it to be like living on a lake up north. What makes it worse is how they pay virtually nothing to live there. They get no sympathy from me whatsoever. If they want peace an quiet there are many many many places in this country in which to get it that aren't next to a major city and that aren't next to an airport. |

Oh they bitch about the boats and the planes too. Thats part of the reason they lobbied (successfully) to have the island bridge stopped and to ban most commuter airlines from operating.
These idiots practically dictate the politics of the city and I'm sick of them. |

That bridge cancellation was NOT GOOD!
Cost alotta $$ cause it was already a done deal.

While that is absolutely true, you don't exactly go and take out a hotel room in the heart of the Las Vegas strip and then make noise complaints. Like Jayx1 said, the islanders have some highly unreasonable expectations if they want their area to be a sanctuary of peace and quiet.
If I were in charge I'd throw a box of ear plugs at 'em and tell them to STFU.... ;) |
