exactly, so what is the point of banning smoking in your own home.
I own my place and I will be the first one to tell them to off if they come knocking on my door!

that is not a valid comparison, IMHO (and I don't think they *ought* to stop selling cigarettes either...I honestly could care less if people choose to smoke)

but I can get *wasted* right beside you and it does not impact your health at all...in comparison to sitting beside a smoker or having a fellow tenant's smoke diffuse into your apt.

I want everyone on the anti-gov't intervention side to google the "harm principle" and tell me that it doesn't make sense with regard to pretty much *any* restriction on our "rights". Wikipedia has a concise quote from Mill on the subject.

shouldnt the landlord have the right then to choose whether or not to rent to smokers and non smokers and shouldnt the non smokers be able to decide whether they want to move into a smoking allowed shared house or not?

Why is it always up to big brother? If the market exists and people want this badly enough, it will happen. The law should say that shared housing is either "smoking" or "non smoking" as determined by the landlord and should only be for such types of dwelling. Im pretty sure room mates are able to choose smoking and non smoking room mates when they rent out a room without the government stepping in. Why should this be any harder?

Thats EXACTLY how it should be!

AFAIK, it's not enforceable in a rental building/unit...but is enforceable in a condo so long as the limitation is written right into the condo's delcarations and/or by-laws.

Just because something is written into a contract, or there's a sign posted saying such-and-such, it doesn't *automatically* make it legal/illegal.

I would rather see cigarettes become illegal. That will never happen because our government makes too much money from the tabacco industry.

Stop stepping on our rights and make it all together illegal.

Interesting. I didnt know this....

Gonna see what my dad knows, he rents out 3 houses.

Hes the one i found out from that its illegal to charge first and last month's rent... u can only ask for ONE or the other! NOT both!

(that said, more than 75% percent of places prolly demand both, and if u wont pony both up... well, , i guesss u dont get hte place... which sucks, bc a lot of good trying ot make a case out of it is gonna do.. cost u all the time, money and u still dont ahve a place to live.

atleast w/ the pets, well, u can say u wont, but when u do get them anyways, they cant kick u out for it.

It is not illegal to ask for 1st and last month's rent. It is illegal to ask for 1st and last and a deposit for the place. Your last is considered a deposit and therefore you cannot ask for more then 2 times the monthly rental price to get the place.

they tried that once. People kept drinking and gangsters made a fortune.

Prohibition doesnt work as proven time and again.

Mark,

All I have to say is something that I believe in and practice. If living next to people is annoying, make enough money so that you can buy a house all to yourself. In the meantime, putting up with close quarters neighbours and their habits is the price we pay for living cheaply in quadplex or duplex.

I had an apartment neighbour with a yappy dog. But because the dog yapped mostly during the day i felt no need to even confront the owner as it was daytime. Until of course that neighbour complained about my music (which wasnt very loud). Then it was oooooooooon! LOL

I think it's more like "that'll never happen because there would be a public outrage".

Do you remember the prohibition? Banning cigarettes would cause an entirely different problem all together. One that is much worse, and probably a lot harder to fix.

"Health Canada estimates tobacco-related health care costs total $4 billion annually in Canada."

In 1999 - 2000 the revenue from tobacco sales was a little over 4 billion three hundred thousand.

So basically, we're pulling out pretty close to even.

It isn't like the government is pocketing that money anyway. That money goes back into education, road maintenance etc.

Anyway, I'm not really sure where I stand on this issue.

Legalize everything and make it available at the LCBO. That will put a lot of organized crime out of business. It will also ensure that what you get in your drug of choice is what you get instead of it being cut with rat poison or god knows what.

And this is coming from me, a non smoker/ light drinker/ non drug user.

I agree with this bylaw being implemented, I can't stand the horrible smell emanating from some of the units in my building, its disgusting. You want to smoke, buy a house or do it outside.
