but I can get *wasted* right beside you and it does not impact your health at all...in comparison to sitting beside a smoker or having a fellow tenant's smoke diffuse into your apt.

I want everyone on the anti-gov't intervention side to google the "harm principle" and tell me that it doesn't make sense with regard to pretty much *any* restriction on our "rights". Wikipedia has a concise quote from Mill on the subject.

Oh...I don't disagree....that smokers shouldn't be able to smoke in public buildings or in businesses....to suggest that a smoker cannot smoke in their own residence is another thing wether its a rental apartment or not. When it comes to shared housing then the owner should make it clear as to whether or not it is a smoking residence before people move in....then they can make the decision if they wish to live there or not.

they tried that once. People kept drinking and gangsters made a fortune.

Prohibition doesnt work as proven time and again.

The government has also tried raising cigarette prices through the roof and it caused more theft from stores and more cross boarder sales.....I get my smokes for $10-$15 a carton.

shouldnt the landlord have the right then to choose whether or not to rent to smokers and non smokers and shouldnt the non smokers be able to decide whether they want to move into a smoking allowed shared house or not?

IMO the landlord should be allowed to decide whether pets or no pets and smoking no smoking..

or

perhaps be allowed to charge higher for pet owners/smokers to cover cleaning charges/paint/carpeting for when the tenant leaves.....

I Know smoking pisses of alot of people... put it this way.. i smoke where i want to..i will not smoke in a resturant,my apartment i will not smoke, my car sometimes, if i am at work ,, i should be able to smoke where the employer says(almost any where) but now i have to go out side everytime in an uncovered area, freeze my balls off, to have a smoke. i hate this.... this is bulls%$t... even though i don't smoke in my apartment i think it should be up to the landlord and the tennant.....the ontario government should keep out of it.. they already are getting enough off of us in taxes.

Mark,

All I have to say is something that I believe in and practice. If living next to people is annoying, make enough money so that you can buy a house all to yourself. In the meantime, putting up with close quarters neighbours and their habits is the price we pay for living cheaply in quadplex or duplex.

I had an apartment neighbour with a yappy dog. But because the dog yapped mostly during the day i felt no need to even confront the owner as it was daytime. Until of course that neighbour complained about my music (which wasnt very loud). Then it was oooooooooon! LOL

to a great extent, I agree with you. Unfortunately, we can't legislate considerate behaviour towards our neighbours, in many cases.

food smells in hallways, minor noise at reasonable hours...those are not "harmful", they are annoying.

I find the smoking case to be unique in that it's more than a mere annoyance that ought to (within reason) be tolerated...it is an avoidable health issue.

I would support that too...

but I would make it law that *every* tenancy agreement must explicitly state the smoking/non-smoking status of the building and that said status cannot be changed without a significant majority of the affected tenants voting in favour of the change.

i.e. I should not have to tolerate neighbours moving in after me, who smoke, if I was told when I moved in that it's a non-smoking building/house.

let the landlords decide...but make them put it in writing ahead of time and have an EXPEDIENT remedy in place for negligent landlords.

Currently it pretty much takes months to evict someone, regardless of wtf they are doing...it's ridiculous.

part of the problem is that a "landlord" can be one guy renting out a room or it can be a management company that runs a dozen (or more) apt buildings. their motivations, their capacity to listen to the tenant(s), and their ability to quickly act (or be forced to act) are quite different.

"Its adherents believe so-called second hand smoke can seep through phone jacks, electrical outlets, ceiling fixtures, cracks in walls and gaps around sinks, and through floors, walls and windows. So they want to ban smoking in multi-unit dwellings. Not simply in elevators or hallways - but in a person's own private home."

get ready for profanity..$%#%@%#%$#!@$!#!$!##$@%&&$#%!#$@.......
this aint gunna happen....i'll go Jack Bauer on the Canadian Government.....

"ethnic food odours" are not carcinogenic.

there's a difference between an annoying odour and a toxic substance ;)

but they make a good point. Whats next? Banning airspray and cooking in peanut oil?

Seriously, if it bothers you that much buy a house.

markT - in almost every single thread you say what I would like to say if i could articulate it

people that are comparing cigarette smoke to food smells really need to re-think that argument

jayx1 - how about some solutions? compromise? scary word for you i know, but try to fit some in your rants. i like the idea of having a building declared by the owners either smoking or non-smoking. if there are multiple owners and they cannot agree, by default it should be NON-smoking (because its BETTER FOR YOU). this should be made public, and anyone choosing to rent in a particular place should be made aware beforehand what kind. that way people that want to stink up their place can do it all together, and those who end up in one of those buildings THEN it is their own fault
7-4-7
they banned cigarettes in clubs and that still happens
they banned smoking the reefer that still happens
they want to ban cigarette smoking in condos that will still happen

this is a garbage law, a dull read and a poor sign of the state of political thinking.
