That's the car.

I like it... smoothe ride, looks nice. The only thing that I'm not really crazy about is the fact that it is a VERY popular car... so everyone and their dog has one.

Meh.

zharen: the key is normally kept in the car so really its not much of a "anti-theft" feature if you think about it. hence why overall i dont really like them but sometimes are a necessary evil.

no honda has been using a key since the early 90's Legends (acura).

Pointless. The law in Ontario is quite clear on this point. If one strikes a stationary object that is on, in, or part of the ground the operator of the striking vehicle is at-fault for the collision. In order to successful sue the city for this one would need to:
a) prove that the city was or ought to have been aware of this object on the road
b) prove that they willfully failed to remove the object despite having knowledge of it's position, knowing that it posed a danger to motorists, and had sufficient opportunity to do so
c) prove that collision with the object was unavoidable (ie. prove that it was impossible for the driver to either stop or manouver around the object)

In this instance, point a and b would be extremely difficult to prove and point c would be impossible. The truth is; if the operator of the vehicle were driving with due care and attention at a reasonable speed they ought to have seen the object in sufficient time to avoid the collision. The fact that the collision occured is evidence that the driver of the vehicle was negligent. Even if a and b could be proven the driver would still be on the hook as they had opportunity to avoid collision and failed. Sorry, this is the price for not paying proper attention while operating a vehicle.

With regard to the dealership.... yes, they should have included the key; however, the buyer should have ensured the key was included prior to purchasing the vehicle. There is no real grounds for a negligence claim against the dealership as the purchaser's contributory negligence will be 100% (meaning that if not for the failure of the buyer to ensure the key was provided the failure of the seller to provide the key would not have resulted in the exacerbated damages). Buyer beware.

Sorry this happened T but you're probably ed.... unless it's a reputable dealer who is willing to cover the towing as an act of customer service.

^^^ All above are good points and I would have agreed with all of them. You ARE screwed most likely. Pissed off? Sure, but it won't change anything. Another problem is that the dealer may not just give you the key because there's no way to proove that you never had it in the first place. People loose these all the time, maybe not in your case, but try telling that to the dealer. Your dealer would really have to be nice to just give you the key. In the extreme case they might even ask you to purchase a new set of lock nuts with key. This is due to the fact that the keys come with each set and are not separate. I had a lost key and went though a similar problem. I ended up welding a rod to the nut and extracting it myself (you can't chisel it off). I didn't want to pay (I don't remember how much) the fee for someone else to do it. I couldn't buy a replacement key, only a new set of lock nuts with the new key.

pretty much everyone i know has owned a honda at some point or another in the last 15 years. i dont know any of them that required a lug key except the ones that had aftermarket rims. and thats including my buddies that have s2000s, rsx, integra, and what not.

Sometimes I think she's American cause she's always trying to sue somebody. Didn't she sue her landlord over something?
