Can landlords do this?

So me and my friend/future roomate were checking out an apartment in Williamsburg this past Saturday. We loved it, was great, so we tell the owner lady we'll take it. She said to give her our papers on Tuesday (today) and once they process and go through, we should be ok. Today we call her to arrange a drop-off time for the papers, and she says she already offered the apartment to someone else!!!

We confronted her on it and she said that basically - when she saw myself and my buddy - she noticed that we were young. So she didn't really want to give the apartment to someone who hasn't had a long credit history and rental history, or someone who's only had a job for a year. Both my friend and I work in huge financial firms, have great credit, never missed payments, and here she is judging us just based on our age! Also, we asked her if there are lots of restaurants/bars around. She told us today that concerned her, because - apparently - that signaled to her that we are "partiers".

My question to you guys: is this even legal? As a rentor of property in the state of New York, does she have the right to deny property to someone based on their age, preferences, etc - without having even seen their documents and credit reports!?

and i just had her tell me over my phone that she didn't like our age. If i choose to sue here, will i need that phone recording somehow cuz i wasn't recording ... damn i wish i was!

u can fight all u want, wont get u anywhere. look elsewhere besides u wouldnt wanna have a fishy landlord..3 months into the lease shes gonna start charging you for capital gains and like that u dont wanna have to deal with that.. trust me. just look elsewhere and take it from god that this wasnt for u. ;)

oh i'll look elsewhere, obviously i'm not living in that place now. But this is way out of line and i feel like something needs to be done. Something!

I believe they have every right to do what they did....now if she accepted your signed papers and then gave the apt to somebody else then you prob have a case. Sorry to hear that man.....that really blows.

Same thing happened to me and my roomie when we got an apt last year. It sucks, but there really isnt too much you can do about it. You could make it a legal battle, but then you just waste your time.

Wear a suit next time, and carry a big wallet.......unless papers are inked, its your word against hers, and not worth to fight..you would lose anyway...or carry a tape Recorder next time,..welcome to the real world......

I asked my mom, its illegal (she rents homes to people as well as her usual job, so I figured she may have knowledge on the subject). If you have solid proof that she said this, take her to court, but the problem is, its her word against yours. Its hard to fight. She can just say she never said it. I would just move on to another place because it doesnt sound like you would be happy with a landlord like that anyways. :( sorry to hear stan, I know that SUCKS!!

She doesn't have the right to do that. If she felt you wouldn't be a good tenant then she never should have offered the papers to you for the apartment. I am sure the people that came after you were willing to pay more $$$ and therefore she took the opportunity. The ty part is that you won’t be able to do anything because it all happened verbally. I would however call 311 and report her because she may have done this to other people in the past as well as protecting people in the future to rent from her. Trust me I know the feeling....Jay and I found an apartment that we liked and were going to rent come back to the management office to drop off our security deposit and were told the place had been taken by someone else.....pissed doesn't even describe it cause now we are in a place the smells of smoke, has cig. burns in the floor and on the bathroom sink (all over it), the smoke detector doesn't work, nor does the intercom to hear people outside....I could go on but that covers most of it....oh and of course moving in and then after a long day going to cook something and we find out the oven doesn't work....good !!!
