I'm not sure I'd agree that this type of branding qualifies as commerce, any more than putting one's name at the top of a blog post. People sign or watermark their work so others can't take credit for it; if this legally qualified as commercial use then I think a whole lot of licensing agreements would have to be rewritten. Unless Radio Xex is a corporation, it's still not commercial use.
And anyway, if the Guvernment considers this to be commercial use, why not just say so? "Hi, we permitted you earlier to make videos for personal use, and it's come to our attention that you've been using them for commercial purposes. If you want to continue doing so, you'll have to obtain a media pass through the appropriate channels." Is that so hard? |

Bingo! That's all I really wanted. I've been recording without hassle all this time. Then I decided it would be cool to get Guv to give me permission to record where the DJ's are... up on the various stages. I sent a list of past videos to them, as I was very proud of them, hoping they would be so impressed that a Guv fan would compliment the place to go though that much trouble.
It's starting to look like I was clearly mistaken. |

the guvernment didnt say anything about it being commercial use. those are my words. |

here is where i think one of the problems lie in regards to giving you access to the stage....
if your videos are for private use like you and diginut claim they are and the club gives you access or media pass to go on stage then they will have to allow everyone that has a camera on stage to be fair to all. and here is another thing that you may have overlooked.... you are not media. private use does not qualify as media.

This is true, but what other term could be used to get stage access. I'm just looking for a different method of making the videos. I've hit every other angle in the club so it only makes sense to be able to get video from where the DJ's are. Shots of them performing and being able to see the crowds reactions at the same time. I'm not media... but the opportunity to record near the DJ's would be great from time to time. |
